The Elk River Vision <br />A welcoming community with revolutionary and spirited resourcefulness, exceptional service, and community <br />engagement that encourages and inspires prosperity <br /> <br />Request for Action <br /> <br />To <br />City Council <br />Item Number <br />4.7 <br /> <br />Meeting Date <br />November 17, 2025 <br />Prepared By <br />Zack Carlton, Community Development Director <br /> <br />Item Description <br />Development Contract Oakwater Ridge 1st <br />Addition <br />Reviewed by <br />Cal Portner <br />Tina Allard <br /> <br />Action Requested <br />Approve, by motion, the development contract for Oakwater Ridge, subject to the condition that all <br />conditions of approval for the final plat of Oakwater Ridge have been satisfied. <br /> <br /> <br />Background/Discussion <br />The City Council approved the final plat for the first addition of the Oakwater Ridge Subdivision on <br />November 3, 2025. One of the conditions of approval for the plat requires the developer to enter into a <br />development contract with the city. The document outlines the costs and responsibilities of the developer, <br />along with warranty and financial surety arrangements. <br /> <br />The contract follows our general template, but the developer has asked for a change to the timing for building <br />permits and certificates of occupancy issuance. Historically, the city has not issued building permits until all <br />public improvements (streets, sidewalks, water, sewer, storm sewer, etc.) and private utilities (gas and <br />electric) have been completed. This is done to ensure that new residents can move into a completed home as <br />quickly as possible upon completion of construction and to ensure the public improvements are not damaged <br />during construction. <br /> <br />The contract provides an exception that allows half of the new lots (45 homes) to be eligible for a building <br />permit prior to completion of the private utilities and sidewalk, and for those homes to be eligible for <br />certificates of occupancy after private utilities have been completed, but prior to sidewalk work. <br /> <br />Staff agreed to this exception for the first addition as a means to support the developer as they kick off the <br />large subdivision. Future additions will follow our standard process for issuing building permits and certificates <br />of occupancy. <br /> <br />Financial Impact <br />None <br /> <br />Mission/Policy/Goal <br />Support the growth and development of the community. <br />Meet changing needs - agile. <br />Page 54 of 379
