<br /> <br />September 25, 2025 <br /> <br /> <br />City of Elk River <br />Justin Femrite <br />13065 Orono Parkway NW <br />Elk River, MN 55330 <br /> <br /> <br />RE: Letter Agreement between Client and AE2S <br />Jonny Pop IU Agreement Development - Elk River, MN <br />P05181-2025-002 <br /> <br />Dear Justin Femrite, <br /> <br />Advanced Engineering and Environmental Services, LLC (AE2S) proposes to render engineering services <br />regarding Elk River Jonny Pop Significant Industrial User (SIU) Agreement Development located in Elk River, <br />MN (Assignment) to City of Elk River (CLIENT). <br /> <br />This Agreement, including Exhibit A, sets forth the terms and conditions under which the CLIENT and AE2S shall <br />be governed regarding the Assignment. <br /> <br />Scope of Basic Services <br /> <br />AE2S will perform the following tasks: <br /> <br /> Kick off meeting and site visit. <br /> Coordinate with City to identify Pollutants of Concern (POC), including review of up to ten (10) <br />Industrial User's cleaning chemical Safety Data Sheets. <br /> Estimate allowable SIU POC loadings to the WWTF and define load allocation to Industrial User. <br /> Propose local limits based upon allowable loading to the City's WWTF to prevent interference or pass- <br />through of the City's WWTF. <br /> Development of IU agreement, including. <br />1. Agreement authorization language. <br />2. Monitoring and reporting requirements. <br />3. Local limits for SIU. <br />4. Rates and surcharges. <br />5. Spill and slug discharge reporting requirements. <br />6. Enforcement provisions. <br />7. General conditions. <br /> Provide a spill and slug template for City and Jonny Pop to define a notification procedure. <br /> Assistance with completing Minnesota Pollution Control Agency Pretreatment Notification of a <br />Significant Industrial User form. <br /> Conduct one (1) in-person meeting with the City and Jonny Pop to discuss the following: <br />1. Identified POCs. <br />2. Recommened monitoring of the POCs. <br />3. Proposed local limits for Jonny Pop. <br />4. Spill and slug load notifications to the City. <br />
