ARTICLE 2 PARTIES <br />The parties to this Agreement are Elk River, Big Lake, Becker and County, acting on <br />behalf of the SCSO (together, the "Parties," or individually, a "Party"). <br />ARTICLE 3 TERM <br />This Agreement shall be effective upon approval of the Parties' respective governing <br />bodies and shall remain in effect until terminated by the Parties or the vehicle service life is <br />complete. <br />ARTICLE 4 OBLIGATIONS AND RIGHTS OF ELK RIVER <br />When the Traffic Safety Vehicle is not in use, Elk River shall be responsible for housing <br />and parking the Traffic Safety Vehicle at the Elk River Police Department garage. At the time of <br />any check-out of the Traffic Safety Vehicle, a designated Elk River Police Department employee <br />shall assist any Party with the check-out. Elk River shall produce and make available a form for <br />any Parry checking out the vehicle to complete at the time of check-out. <br />ARTICLE 5 GENERAL OBLIGATIONS AND RIGHTS OF ALL PARTIES <br />5.1. Cooperation. The Parties agree to cooperate and use their reasonable efforts to <br />ensure prompt implementation of the various provisions of this Agreement and to, in good faith, <br />undertake resolution of any dispute in an equitable and timelymanner. <br />5.2. Compliance with Laws. Each Party shall abide by all federal, state, or local laws, <br />statutes, ordinances, rules, and regulations in implementing the Traffic Safety Vehicle Program <br />and using the Traffic Safety Vehicle. <br />5.3. Work Plan. Each Parry may check out and use the Traffic Safety Vehicle to enforce <br />traffic laws and educate Minnesota drivers with respect to traffic laws (the "Work Plan"), as <br />follows: <br />236613v2 <br />a. During annual "Toward Zero Death" (or "TZD") traffic enforcement dates; <br />and <br />b. During other annual TZD enforcement dates related to DUI, seat belt, child <br />restraint enforcement; and <br />C. For any other dates not listed in this Article V in order to enforce traffic <br />laws and educate Minnesota drivers with respect to traffic laws. <br />Page 68 of 104 <br />
