JOINT POWERS AGREEMENT <br />FOR TRAFFIC SAFETY VEHICLE PROGRAM AMONG <br />THE CITIES OF ELK RIVER, BIG LAKE, BECKER <br />AND THE COUNTY OF SHERBURNE <br />WHEREAS, Minnesota Statutes, Section 471.59 authorizes local governmental units to <br />jointly or cooperatively exercise any power common to the contracting parties; and <br />WHEREAS, the City of Elk River (Elk River), City of Big Lake (Big Lake) and City of <br />Becker (Becker) are each a Minnesota municipal corporation and political subdivision of the State <br />of Minnesota and a governmental unit within the meaning of Minnesota Statutes, Section 471.59; <br />and <br />WHEREAS, the County of Sherburne (County) is a political subdivisions of the State of <br />Minnesota and a governmental unit within the meaning of Minnesota Statutes, section 471.59 and <br />enters into this Agreement on behalf of the Sherburne County Sheriff's Office (SCSO); and <br />WHEREAS, according to the Minnesota Office of Traffic Safety, "[d]istracted or <br />inattentive driving is when a driver engages in any activity that might distract them from the <br />primary task of driving and increases their risk of crashing;" and <br />WHEREAS, pursuant to Minnesota's traffic law (commonly referred to as the "Hands - <br />Free" law), it is illegal for drivers to read, send text messages and emails, or access the internet <br />while the vehicle is in motion or a part of traffic; and <br />WHEREAS, pursuant to a federal grant program, the Elk River Police Department has <br />received a vehicle (the "Traffic Safety Vehicle") that may be used to enhance the capabilities of <br />police departments to enforce traffic laws and educate Minnesota drivers with respect to traffic <br />laws; and <br />WHEREAS, Elk River, Big Lake, Becker and County intend to enter into a joint powers <br />agreement to develop a work plan and additional future work plans for the use of the Traffic Safety <br />Vehicle for such capabilities (the "Traffic Safety Vehicle Program"); and <br />NOW, THEREFORE, in consideration of the mutual promises and benefits that the Parties <br />shall derive from this Agreement, the Parties each hereby enter into this Joint Powers Agreement <br />(the "Agreement"). <br />ARTICLE 1 PURPOSE <br />The purpose of this Agreement is to define the Traffic Safety Vehicle Program <br />obligations of the Parties. <br />236613v2 <br />Page 67 of 104 <br />
