City of <br />Elk - - <br />River <br />To <br />Planning Commission <br />Meeting Date <br />April 23, 2024 <br />Item Description <br />Conditional Use Permit: PUD Amendment for Taco <br />Bell Signage <br />Request for Action <br />Item Number <br />4.1 <br />Prepared By <br />Chris Leeseberg, Senior Planner <br />Reviewed by: <br />Zack Carlton <br />Action Requested <br />Recommend, by motion, approval of a PUD amendment limiting the freestanding sign height consistent with <br />the C-3 (Highway Commercial) sign ordinance. <br />Background/Discussion <br />The property is zoned Planned Unit Development (PUD) where changes to size regulations ("variances") <br />require a Conditional Use Permit (CUP) to amend the PUD agreement. The applicant is seeking a CUP to <br />allow signage consistent with the C-3 (Highway Commercial) sign ordinance. <br />On April 15, 2024, the City Council approved an amendment to Section 30-871 essentially capping sign <br />heights to 40-feet above the nearest point grade of the main line of Highway 169. The ordinance also <br />accounts for grade changes along Highway 169. <br />Many commercial properties along Highway 169 that would benefit from this amendment are in PUD districts <br />and the city cannot initiate an amendment to those standards. Landowners within each PUD will need to <br />request an amendment to their sign regulations, as this applicant has done. <br />Applicable Regulations <br />In approving a Conditional Use Permit, the council may impose such specific conditions with regard to the <br />development or operation of the proposed use as it considers necessary to satisfy the seven standards set <br />forth in Section 30-654 and the requirements contained in this article and to promote compatibility with and <br />minimize any potentially adverse effects upon adjacent properties, the neighborhood or the city. <br />The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: <br />I.
