<br />. <br /> <br />. <br /> <br />. <br /> <br />Prosource Technologies <br />December 13, 2005 <br /> <br />Page 2 <br /> <br />Overview <br /> <br />The applicant, on behalf of Nextel, is proposing to rezone an area of 50' X 50' to Antenna <br />Overlay and requesting a conditional use permit for a 150' tall antenna tower. The proposed <br />tower will be located on city property, and the city will be placing it's 850 meghertz <br />equipment on the tower. The area is part of a larger 12 acre parcel, which is developed as the <br />city softball complex. The surrounding property is zoned Rlc. The surrounding land uses <br />include the softball complex, Elk River City Hall complex and the Sherburne County <br />fairgrounds. <br /> <br />Prior to considering the applicant's request for a rezoning and conditional use permit, the <br />Commission, acting as the Board of Adjustment, must consider the applicant's request for a <br />variance to the tower setback requirement. If the Board denies the variance request, the <br />request is automatically appealed to the City Council and the Commission should table <br />acting on the rezoning and conditional use permit pending the Council's decision. <br /> <br />Rezoning <br /> <br />In order to construct the proposed tower, a rezoning to AT is required. This overlay district <br />was established to manage the placement of antenna towers and to ensure their proper <br />placement regarding health, safety and welfare of the community. The overlay district does <br />not change the underlying A 1 zoning district, all the uses allowed in the A 1 district will <br />continued to be allowed on land zoned AT. <br /> <br />In considering a rezoning request of this nature, consideration should be given to the <br />compatibility with surrounding land uses and whether the rezoning is necessary to provide <br />effective wireless telecommunication coverage for the city. The proposed rezoning is <br />compatible with the surrounding land uses. The applicant has shown that this site is <br />necessary to provide effective wireless coverage for the city. The rezoning is also consistent <br />with the Comprehensive Plan for the city. <br /> <br />Conditional Use Permit <br /> <br />Co-location Requirements <br /> <br />The applicant has looked at co-locating on other sites within the city. They found that there <br />are no acceptable co-location opportunities within one mile of the proposed site. The City <br />will be co-locating it's 850 megahertz equipment on the tower.
