<br />post frame prefinished metal sided building to house the current and future operations of the business and <br />replacing the existing structures. The new building will be utilized for vehicle/equipment storage, service, <br />maintenance, and office space. Inside and outside storage is also being proposed. <br /> <br />Office hours are 7:00 a.m. - 6:30 p.m. Monday through Friday, and only by appointment on weekends. They <br />currently have 12 full-time and 4 part-time employees. <br /> <br />Site improvements include drive lanes, parking, and impound/storage areas screened with 100% opaque <br />fencing with all circulation outside of the screened fencing on bituminous or concrete surfaces, with curb and <br />gutter. The inside of the fenced area will be finished with either bituminous, concrete, or compacted Class 5 <br />materials. <br /> <br />The property has two access points, one on Jarvis Street and a second on 163rd Avenue and requires 19 <br />parking stalls. The site plan shows 13 parking stalls. <br /> <br />The applicant is collaborating with the neighboring property to the west on a shared holding pond that will <br />span both parcels and serve both properties. If this plan proceeds, the pond must be adequately sized to <br />accommodate the needs of both parcels. Additionally, an easement must be recorded to grant both property <br />owners access to the pond and outline the maintenance responsibilities. <br /> <br />The residential structure remains in use as a residence and is permitted under the I-3 zoning district. <br />However, it exceeds the size allowed by ordinance but can continue as a legal non-conforming structure. <br /> <br />Applicable Regulations <br />The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: <br /> <br />1. Will not endanger, injure or detrimentally affect the use and enjoyment of other property in the immediatevicinity or <br />the public health, safety, morals, comfort, convenience or general welfare of the neighborhood or the city. <br />The properties west of Jarvis Street in the area are also zoned industrial with the properties east of Jarvis, <br />located in Ramsey, zoned residential. Nearby parcels are developed as outdoor storage, mini-storage, other <br />industrial uses, and the Youth Athletic Complex. The use will not endanger, injure or detrimentally affect the <br />use and enjoyment of other property in the immediate vicinity or the public health, safety, morals, comfort, <br />convenience, or general welfare of the neighborhood or the city. <br />Staff do not see a need to impose specific conditions to satisfy this standard. <br /> <br />2. Will be consistent with the comprehensive plan. <br />The property is guided as Industrial. The industrial use category includes both heavy and light industrial <br />businesses such as manufacturing, warehousing, and excavation. These uses are primarily located off of <br />Highway 169, Highway 10, and the BNSF Railroad which provide easy access for the transferring of goods <br />throughout the region. The use will be consistent with the comprehensive plan. <br />Staff do not see a need to impose specific conditions to satisfy this standard. <br /> <br />3. Will not impede the normal and orderly development and improvement of surrounding vacant property. <br />Three of the four adjacent parcels are developed and include outdoor storage and the adjacent vacant parcel <br />is owned by the same property owner as one of the outdoor storage parcels. Nearby parcels are developed <br />as outdoor storage, mini-storage, other industrial uses, and the Youth Athletic Complex. The use will not <br />impede the normal and orderly development and improvement of surrounding vacant property. <br />Staff do not see a need to impose specific conditions to satisfy this standard. <br /> <br />4. Will be served adequately by and will not adversely affect essential public facilities and services including streets, <br />police and fire protection, drainage, refuse disposal, water and sewer systems, parks and schools; and will not, in <br />particular, create traffic congestion or interference with traffic on adjacent and neighboring public thoroughfares. <br />Page 21 of 103
