<br />2023, the Elk River City Coun-
<br />cil adopted Ordinance No. 23-24
<br />amending Sections 30-1, entitled

<br />"Interim Uses"; 30-801, entitled
<br />"Home Occupations; 30-991, en-
<br />titled "R1 District; 30-992, entitled
<br />"R2a District; 30-993, entitled "112b
<br />District; 30-994, entitled "R3 Town -
<br />home District; 30-1027, entitled
<br />"XCR Extreme Commercial Recre-
<br />ation; 30-1583, entitled "CRT Com-
<br />mercial Reserve Transition; 30-
<br />1584, entitled " MU-ERP Mixed Use
<br />- Elk River Plaza; 30-1587, entitled
<br />"Focused Area Study (FAST); 46-
<br />34, entitled "Public Nuisances; and
<br />WHEREAS, Minnesota Statutes,
<br />Section 412.191, Subd. 4 allows
<br />publication by title and summary in
<br />the case of lengthy ordinances; and
<br />WHEREAS, the City Council
<br />finds that the following summary
<br />will clearly inform the public on the
<br />intent and effect of Ordinance No.
<br />23-24; and
<br />WHEREAS, a copy of the full
<br />text of Ordinance No. 23-24 is avail-
<br />able for inspection by any person at
<br />the office of the Elk River City Clerk,
<br />13065 Orono Parkway, during reg-
<br />ular business hours - 8:00 a.m. to
<br />4:30 p.m., Monday through Friday.
<br />NOW, THEREFORE, BE IT
<br />RESOLVED by the City Council of
<br />the City of Elk River, Minnesota, as
<br />follows: That the City Council, by
<br />at least four -fifths votes, authorizes
<br />publication of the title and the fol-
<br />lowing summary of Ordinance No.
<br />23-24.
<br />Public Notice
<br />During their November, 2023,
<br />meeting, the City Council adopted
<br />Ordinance No. 23-24, an ordinance
<br />amending Sections 30-1, enti-
<br />tled "Definitions"; 30-658, entitled
<br />"Interim Uses"; 30-801, entitled
<br />"Home Occupations; 30-991, en-
<br />titled "Ri District; 30-992, enti-
<br />tled "R2a District; 30-993, entitled
<br />"R2b District; 30-994, entitled "R3
<br />Townhome District; 30-1027, en-
<br />titled "XCR Extreme Commercial
<br />Recreation; 30-1583, entitled "CRT
<br />Commercial Reserve Transition;
<br />30-1584, entitled "MU-ERP Mixed
<br />Use - Elk River Plaza; 30-1587, en-
<br />titled "Focused Area Study (FAST);
<br />46-34, entitled "Public Nuisances.
<br />In summary, Ordinance No. 23-
<br />24 makes the following changes to
<br />the aforementioned sections of the
<br />city code:
<br />1. Incorporation of definitions
<br />approved with Ordinance No. 23-
<br />24 for residential occupations in the
<br />aforementioned sections, including
<br />changing "home occupations to
<br />"residential occupations" in all af-
<br />fected code sections.
<br />2. Any occupation that does not
<br />meet the permitted requirements
<br />would be reviewed through an In-
<br />terim Use Permit process.
<br />3. Codifying hours of operation.
<br />4. Limiting motor vehicle repairs
<br />as an allowed residential occupa-
<br />tion to the R1-a district on lots 10
<br />acres or larger.
<br />5. Limiting outdoor storage as
<br />an allowed residential occupation
<br />to the R1-a district on lots 5 acres
<br />or larger, with screening, and set-
<br />back 50-feet or more from all exist-
<br />ing residential structures on neigh-
<br />boring properties.

<br />Council of the City of Elk River this
