<br />Office Space Lease <br /> <br />THIS LEASE, made and executed this _ day of , 2005, by and between the <br />Elk River City Recreation, 1000 School Street, Elk River, MN 55330, hereinafter called <br />the Lessor, and Elk River Youth Hockey Association, PO Box 193, Elk River, MN <br />55330, hereinafter called the Lessee: <br /> <br />WITNESSETH: That in consideration of the payment of rent and the keeping and <br />performance of the terms and conditions herein by Lessee, Lessor does hereby to Lessee, <br />the premises described as: <br /> <br />An office in the southeast comer of the upper level of the Elk River Arena, and a <br />large storage closet located in the southeast comer of the upper level of the Elk River <br />Arena. The Lessor and Lessee agree to shared use of the large closet space. <br /> <br />This lease is for a term of five years, beginning on October 1, 2005, and continues until <br />midnight of October 1, 2010, unless earlier terminated by law or as provided herein. <br /> <br />1) Lessee has first right to renew this lease upon expiration of the five year term, <br />provided Lessee has abided by the agreements, terms and conditions set forth in this <br />Lease. Conditions of the renewal period will be negotiated between the Lessor and <br />Lessee at the time the option is exercised by the Lessee. Lessee shall give Lessor written <br />notice of its intent to renew at least ninety (90) days and not more than one hundred <br />eighty (180) days prior to the expiration of initial lease term or Lease will terminate at the <br />end of initial term. <br /> <br />2) Lessee shall pay rent for said premises to Elk River City Recreation. A yearly rent <br />of $ 2600 subject to any adjustments as hereinafter provided for. Yearly rent shall be paid <br />in full by the first day of January each year for the entire term of the lease. <br /> <br />3) Lessee shall use and occupy the premises for office and storage purposes only and <br />shall not use them in such a manner as to give either governmental authorities, other <br />tenants or Lessor just cause to complain. <br /> <br />4) Lessee shall surrender the premises at the termination of this Lease or any <br />extension thereof in as good condition as they were at commencement of this Lease, <br />reasonable wear and tear or unavoidable casualty expected. <br /> <br />Lessee shall not make any alterations or improvements to the premises or without prior <br />written consent of Lessor, and all improvements, shall remain with the premises at the <br />termination of this Lease and become the property of the Lessor. Liability for cost of <br />replacing or repairing any part of the building or the premises contained therein damaged <br />by Lessee or Lessee's agents or employees shall rest solely with Lessee <br />
