AMENDMENT OF LEASE <br />This Amendment of Lease {"Amendment") entered i��to this ��� day of September, <br />2014, by and between the City of Elk Riwer (`'Landlord") and Elk River Area Chamber of <br />C�mn�erce {"Tenant"). <br />WHEREAS, Lalldlord and Tenai�t entered in�o a Lease datec� Septernber l, I994 <br />("Lease"} pursuant to whicl� Landlord le�sed to Tenant that certain parcel of real property <br />situated in Sl�erburne County, Minnesota, Iegally-described on Exhibit A attached hereto (the <br />"Laz�d''); and <br />WHEREAS, Landlord and Tenant desire to amend and exte�d the term oF th� Lease, as <br />provided in this Amendment. <br />NOW, THEREFORE, Land�ord and Tenant agee as follows: <br />1. Article 2 of th� Lease shall be deleted and replacEd with th� following new <br />Article 2: <br />ARTIGLE 2. <br />TERM <br />2.1) The ter�n of the Lease as ainended shall commence on <br />Se�atember ], �2014, and terminate on September l, 20�7 (the "initial Term"}, <br />unless sooner terminated as provided herein. <br />2.2) Provided the Lease is in full force and effect and Tenant is not in <br />default of any of the tenns or condi�ions of the Lease, Tenant shall have the <br />option to renew the Lease (th�e "Renewal Option") upon the same terms and <br />conditions contained in tY�e Lease, far iwo (2} one-year periods, the first of which <br />shall cominence �epteml�er 1, 2017, and terminate September l, 2018, and the <br />secand of whicll sha11 commence Septe�nber l, 2018, and ter�ninate September 1, <br />2Q19. Each Renewal pptian shall be exercised, if at all, by Tenant giving <br />Landlorc� written notice tlzereof at least sixty (60) days prior tQ expiration of the <br />Initial Term or t�e first Renewal Option. The Initial Term and the Renewal <br />Option are collectively referred to herein as the "Term."' A"Lease Year" shall <br />anean eacll calendar year, in whole or in part, during the Term. <br />2. Section 7,2 of the Lease shall be deleted and be replaced with tlae folAowing new <br />Section 7.2: <br />7.2} Tlie parties agree tl�at Landlord shall maintain the sider;valks, <br />driveway az�d parking areas on the Land, including snow re��oval froxn driveway <br />and parking areas, and that Tenant shall be responsible for snow removal fro�n <br />sidewalks. Landlord agrees to repair and maintain tl�e irrigation system for the <br />
