You mentioned that you do have employees <br />and delivers that come occasionally to your place to pick up and drop off items that pertain to <br />daily/weekly activities of your business and you mentioned that you have construction <br />equipment and materials that are stored on site or in this building. This type of use is not <br />accessory to your home and the structure would not be regulated under the International <br />Residential Code (IRC), which these plans were reviewed to. Your building plans were <br />reviewed under the IRC because nothing in the application indicated that the use of the <br />building was for a commercial use. The IRC only regulates residential dwellings and accessory <br />structures used for personal or private use. The International Building Code (IBC) regulates all <br />other structures that pertain to a commercial use and need to follow these standards. <br /> <br />During our review, staff will make comments to inform the applicant of certain requirements <br />such as minimum setbacks, footing depths, and other items that pertain to the project. I have <br />attached your site plan that was submitted and reviewed that has a staff comment that reads <br />“Home Occupations carried out in an accessory structure require and approved Conditional <br />Use Permit.” Our hope with doing this is to inform residents that if their plans change, there <br />may be other requirements that the City Ordinance or Building Code require. <br /> <br />Based on Section 30-801 (d), the property owner needs to apply for a Conditional Use Permit <br />(CUP). I have attached Section 30-801 you can share with them. <br />
