Permittee shall provide such insurance, including workers <br />eompensari�n insurance, and bon�ing as required in the City License. <br />16.) A licabilit af Conditional Use Permit. Except as specifically provided otherwise in this <br />Permit, this Permit shall appiy to the prop�rt� described on Exhibit A ttached hezeto. This Permit <br />shall nan with the real property and apply to Permittee and its successors and assigns. <br />17.) Perrnit Period. <br />(O1) This Permit shall not become effective until: <br />(a) Permittee has provided City with written documenta�ion of Permittee's ownership <br />interest in all of the real property described on Exhibit A, attached hereto; <br />(b) Permittee has executed this Agreement for Issuance of Amended Conditional Use <br />Permit; and <br />(c) Per�nittee k�as exec�ted a stigulation for dismissal of the case filed in Sherburne <br />County District Court, now known as ERL �; the Appe�lants have withdrawn iheir <br />appeals to the Minnesota Court of Appeals in the matters known at ERL I, II a.nd N, <br />and all parties to the ERL I, II, I.11 and Nlitigaiian have e�ecuied mutuaZ releases of <br />all claims arising £�`om tha� litigation. <br />(02) Once effective, this Permit shall be in farce and effect for so lang as the conditions set forth <br />herein are camplied wiih, unless and untii suspended or revoked as pravided herein. <br />(43) Until this Permit becomes effective, tne Existing CUP far the Landfill shall remain in <br />effeci and no Landfill activities shal� be permitted on any land noi covered by the Existing CUP. <br />Tne Existing CUP shall automatically terminate an the date that this Permit becornes effective. <br />1$.) Violation of Conditions. If ti�e Permittee or its successar5 or assigns violates any ter�n or <br />condition impased by this Permit, or any soIid waste facilities license issued for apexation of the <br />Landiill, this Permit may be re�oked ar�d terminated. Without iimiting the �oregcing, the vialatian <br />of any statute, reg�zlation, ordinance, permit or license condition imposed by lawful governmental <br />authority and governing operations on the Landfill Property is grounds for suspension, revocation <br />or termination Qf this Conditional Use Permit. The cha.r�.ge, alteration, or amendrnent of any such <br />statute, regulation, ordinance, perznit or license condiiion by any goveFnmental authority other tnan <br />the City shall nat excuse the �'ern�.ittee from corz�pliance with statutes, regulations, or�inances, <br />permii or license conditions in e�'fect on the date of the ariginal issuance of this Permit, unIess <br />compliance is waived ar excused by the City Council.
