The pond includes perimeter grading modifications to the southern portion of the landfill within the previouslyT <br />permitted pYopertyr boundaryr and incorpoYates a varietyr of tree types for screening purposes. This can be seen on <br />the attached landscape plan. <br />Applicable Regulation <br />In approving a Conditional Use Permit, the Council mayT impose such specific conditions with regard to the <br />development or opeYation of the pYoposed use as it consideYs necessary to satisfy the seven standards set foYth in <br />section 30-654 and the requirements contained in this article and to promote compatibilityT with and minimize any <br />potentially adveYse effects upon adjacent pYopeYties, the neighborhood, or the cityr. <br />The issuance of a Conditional Use Permit can be ordered only if the use at the pYoposed location: <br />1. LVill not en�iingeT; injuze oT� detzz�nentally affect the use and enjoy7nent of othe��properfiy in the iln�nediate vicinity oz• the pul�lic <br />health, safety, �no�als, coynfo�fi, convenience oz•general �elfare of the neighl�oThood o�� the city. <br />With the expansion of the storm`vater pond only and no increase in capacityT of the landfill, the use `vill not <br />endanger, injure or detrimentally affect the use and enjoyment of other propertyT in the immediate vicinityT or <br />the public health, safety-, morals, comfort, convenience or general welfare of the neighborhood or the cit�T. <br />Staff do not see a need to impose specific conditions to satisf�r this standard. <br />2. LVill be consistent �a�itb the co7npTebensive plan. <br />The comprehensive plan guides the propertyT as IndustriaL The industrial use categoryT includes both heavyT <br />and light industrial businesses such as manufacturing, �varehousing, and excavation. These uses are primarilyT <br />located off of High��ay 169, Highway 10, and the BNSF Railroad which pYovide easy access foY the <br />transferring of goods throughout the region. The use is consistent `vith the Comprehensive Plan. <br />Staff do not see a need to impose specific conditions to satisfyT this standard. <br />3. LVill not ilnpede the noz7nal and oTdeT•ly developinent and i�npTovesnent of suy�ounding vacayatpTope�iy. <br />The vacant parcels surrounding the subject parcel are engaged in mining activities with some large lot single <br />familyr residential uses to the west The use will not impede the noYmal and oYderly development and <br />improvement of surrounding vacant propertyT. <br />Staff do not see a need to impose specific conditions to satisf�- this standard. <br />4. LVill I�e seTved adequately l�y and 2a�ill not adve�:sely affect essential pul�lic facilities and seTvices including streets, police and fi� e <br />protection, dr•ainage, zefuse disposal, �a�ateT� and se2��er systelns, paTks and schools; and �a�ill not, in paT�fiicular•, cr�eate tTa�c <br />congestion or inteT, feTence �a�ith t�a�c on adjacent and neighl�o�zngpublic thoToughfaTes. <br />The expansion of the stormwater pond will not adverselyT affect essential public facilities. <br />Staff do not see a need to impose specific conditions to satisfyT this standard. <br />5. LVill not involve uses, activities, pT ocesse�; lnate�zals, equ pinent and conditions of operation that �a�ill l�e det�zmental to any <br />pe�:sons oT�propeT�y I�ecause of excessive tra�c, noise, s�noke, fu�nes, glare, odor:s, dust o�� vil�Tation.r. <br />The storm`vater pond `vill not create excessive traffic, noise, smoke, fumes, glare, odors, dust or vibrations. <br />Staff do not see a need to impose specific conditions to satisfy this standard. <br />
