The contractor shall maintain insurance to cover claims, which may arise from operations under a <br />contract with the city, whether such operations are by Contractor or Subcontractor or by anyone <br />directly or indirectly employed under this contract. <br />d) If Contractor's work involves working with, or the potential release of a hazardous substance, then <br />the Contractor shall be required to procure double the insurance policy limits of those noted above. <br />4.81 Additional Insured <br />An important requirement of the contract insurance is that the city be listed as "Additional Insured" on a <br />primary and non-contributing basis by being added to your liability policy by endorsement. This <br />endorsement must accompany the certificate and must be provided to the city prior to the Contractor <br />beginning any work for the city. It may be mailed via regular U.S. mail or may be emailed to: <br />Mailing address: <br />13065 Orono Parkway <br />Elk River, MN 55330 <br />Email address: <br />bpelarski@elkrivermn.gov <br />4.82 Contractual Liability Format <br />The contractual liability is to be either on a blanket basis for all written or oral contracts, or specifically <br />endorsed to acknowledge the contract between the insured and the city. <br />4.83 Written Notice of Insurance Cancellation <br />All certificates of insurance shall provide that the insurance company shall give the city thirty (30) days prior <br />written notice of cancellation, non -renewal or any material changes in the policy. <br />4.84 Additional Insurance <br />The above requirements are minimum amounts, and it is the sole responsibility of the contractor to <br />purchase and maintain additional insurance that may be necessary in connection with this contract. <br />4.85 Possession of Firearms on City of Elk River Premises <br />Unless specifically required by the terms of this contract, no provider of services pursuant to the contract, <br />including but not limited to employees, agents or subcontractors of the Vendor or Contractor shall carry or <br />possess a firearm on city premises or while acting on behalf of the city pursuant to the terms of this <br />agreement. Violation of this provision shall be considered a substantial breach of the Agreement; and in <br />addition to any other remedy available to the city under law or equity are grounds for immediate suspension <br />or termination of this contract. <br />20 <br />
