4.60 Indemnification, Insurance, and Protection of Lives and Property <br />The contractor shall defend, indemnify and hold harmless the city and its officers and employees from and <br />against all claims, damages, losses, expenses, including but not limited to attorney's fees, arising out or <br />resulting from the contractor's, its agents', or its assigns', performance of the contract. <br />In any and all claims against the city or any of its officers or employees by an employee of the contractor, <br />and subcontractor, anyone directly or indirectly employed by any of them or anyone for whose acts any of <br />them may be liable, the indemnification obligation under this paragraph shall not be limited in any way by <br />any limitation of the amount or type of damages compensation or benefits payable by or for the contractor <br />of any subcontractor under worker's on workmen's compensation acts, disability benefit acts or other <br />employee benefit acts. <br />The contractor must meet the insurance requirements in Section 4.80. <br />4.61 Injury or Damage to Person or Property <br />Should either party to the contract suffer injury or damage to person or property because of any act or <br />omission of the other party or of any of his or her employees, agents or others for whose acts is liable a <br />claim shall be made in writing to such other party within a reasonable time after the first observance of such <br />injury or damage. <br />4.62 Reasonable Safety Precautions <br />The contractor shall take all reasonable precautions for the safety of, and shall provide all reasonable <br />protection to prevent damage, injury or loss to: <br />a) Employees at the site and other persons who may be affected thereby. <br />b) His or her work and materials and equipment to be incorporated therein which are under the care, <br />custody and control of the contractor or any of his or her subcontractors. <br />c) Other property at the site or adjacent thereto. <br />4.63 Management of Workload <br />The contractor shall provide the appropriate number of employees and supervision to assure that the <br />workload is managed proficiently, assuring that the contracted buildings are cleaned to specifications. The <br />contractor shall also supervise and direct the work of the contract using his or her best skill and attention <br />and shall be responsible to the city for the acts and omissions of his or her employees, subcontractors, and <br />their agents and employees. <br />4.70 Insurance Indemnity <br />Unless otherwise provided by the city, the contractor in all cases will be required to carry insurance of the <br />kinds and in the amounts hereinafter specified. The contractor shall not commence work under the contract <br />until he or she has obtained all the insurance required by the specifications and until such insurance has <br />been approved by the owner or its agents. <br />18 <br />
