Section 3 <br />Award and Execution of Contract <br />3.10 Consideration of Proposals <br />After the proposals are opened, they will be compared on the basis of the proposal price and who in the <br />judgment of the city would best comply with the requirements. <br />3.11 Rejection of Proposals <br />The right is reserved to reject any or all proposals, to waive defects and technicalities or to ask for new <br />proposals if, in the judgment of the city, its best interest will be promoted thereby. <br />3.20 Award of Contract <br />The award of contract, if it be awarded, will be made within sixty (60) calendar days after the opening of <br />proposals to the lowest responsible proposer who in the judgment of the city best complies with all <br />prescribed requirements. The successful proposer will be notified by letter, mailed to the address shown on <br />his or her proposal, that his or her proposal has been accepted subject to execution and approval of the <br />contract as required by law. <br />As a condition precedent to approval of a contract, a foreign or nonresident corporation to whom a <br />contract is awarded shall furnish proof that it has met all legal requirements for transacting business in the <br />State of Minnesota. <br />3.30 Cancellation of Award <br />The city reserves the right to cancel the award of any contract at any time and for any reason before the <br />execution of said contract by all parties without any liability against the city. <br />3.40 Execution and Approval of Contract <br />The contractor shall be signed by the successful proposer and returned within thirty (30) days after the <br />forms have been mailed to the proposer. If return of the executed forms within the specified time is <br />impossible due to the absence of one or more of the required signers, an extension of time may be granted <br />by the city provided satisfactory evidence is furnished that the forms will be executed. <br />3.41 Signature Requirement <br />All members of a partnership, and the president or vice president and the secretary or treasurer of a/each <br />corporation shall sign the contract. In the case of joint ventures, signature requirements shall apply to each <br />firm represented. <br />3.42 Proposer's Notice of Approval or Disapproval <br />Notice of approval or disapproval of the contract will be given to the successful proposer within ten (10) <br />days after the forms have been properly executed and returned to the Contracting Authority. No award shall <br />be considered binding, nor shall any contract become effective until the contract form has been fully <br />executed and approved as required by law. <br />15 <br />
