292456 <br />3.) Levy of Special __s m n - Developer has agreed that <br />special assessments shall be levied against the Subdivision for <br />the cost of reconstructing 193rd Avenue, trunk and lateral <br />utilities, and signalization of the intersection at 193rd Avenue <br />and Highway 169, as follows: <br />(01) Special assessments to be„gvied against Lot 1, <br />Block Z - The following special assessments shall be levied <br />against Lot 1, Block 1 of the Subdivision: <br />Trunk Sanitary Sewer and Water $ 4,294-00 <br />Lateral Sewer and Water Benefit 6,800.00 <br />Signalization of 193rd/TH-169 Intersection 7,500.00 <br />Total $18,594.00 <br />(02) Special assessments to be levied against g3ajot A - The <br />following special assessments shall be levied against Outlot A <br />of the Subdivision: <br />c $23,650.00 for Reconstruction of 193rd Avenue <br />° $3,800.00 per gross acre for Trunk Sanitary Sewer and <br />Water <br />° Assessments for Lateral Sewer and Water Benefit shall <br />be levied as provided by the City Assessment Manual <br />at the time of replatting <br />4.) Payment of Special Assessments,- <br />(01) Special assessments levied against Lot 1, Block 1, in <br />the amount of $18,594.00, shall be paid in full prior to <br />release of the final plat of the Subdivision for recording. <br />(02) The special assessments against Outlot A identified in <br />Section 3(02) of this Agreement shall be levied at the time <br />utilities are made available or when Outlot A is replatted, <br />and paid as provided in a subsequent Developer's Agreement to <br />be entered into at that time. <br />5-) park Dgdi Lion - <br />(01) Lot 1. Block 1 - In full satisfaction of the dedication <br />requirements of Section 1008,18 of the Subdivision Ordinance, <br />the City agrees to accept and the Developer agrees to pay the <br />sum of $1,695.00, to the City, which Developer agrees is <br />equivalent to the fair market value of the land which it would <br />be required to dedicate to develop Lot 1, Block 1. The above <br />sum shall be paid prior to release of the final plat for <br />recording. <br />(02) Outlot p - Park dedication shall also be required for <br />development of Outlot A. The amount of land to be dedicated, <br />or cash to be paid, shall be determined by the city Council at <br />the time of the replat of Outlot A. <br />
