City Council Minutes <br />October 17, 2022 <br />Page 8 <br />Peter McGee,10653 172nd h Ave, was in support of newer apartments being <br />available in Elk River. <br />Keith Glenn, 704 Jackson Ave NW, stated he was not against the development but <br />that he was concerned about wet soil conditions, structural stability, and the view of <br />the parking lot from his yard. <br />Ricky Solomon, President/CEO of Boys and Girls Club of Elk River, spoke in <br />favor of the fishing pond located in the development. <br />Patrick Briggs, Jackson Hills, applicant, stated he hired an engineer to give <br />information on building on the site and has no concerns with the project location. <br />Mayor Dietz closed the public hearing. <br />Mayor Dietz asked about park dedication for this project. Mr. Carlton stated that <br />there was no park dedication needed because of a previous dedication, which <br />included Lion John Weicht Park. <br />Mr. Carlton added that none of the conditions of the CUP exempt the developer <br />from standards related to structural stability and the development must meet all state <br />building codes. <br />Councilmember Wagner stated that the Parks and Recreation Commission should be <br />informed that there is no park dedication as they are replacing a playground soon <br />which will not be large enough for an increase in residents. <br />Moved by Councilmember Westgaard and seconded by Councilmember <br />Christianson to approve a Conditional Use Permit establishing a residential <br />Planned Unit Development (PUD), with the following conditions: <br />1. A PUD Agreement shall be developed and signed by both parties prior to <br />issuance of a building permit. <br />2. Staff approval of landscape and lighting plans. <br />3. All utility meters shall be on an elevation of a building that does not face a <br />public right-of-way. <br />4. The developer shall provide evidence that any long-term dewatering will <br />not be detrimental to the stormwater system or the long-term structural <br />integrity of the proposed structures. <br />5. On -site mitigation must be monitored by a certified professional and <br />building permits will not be released until a final report has been provided <br />to the city. <br />6. Water service pipe over 21/2" in size shall be ductile iron. <br />7. Hydrants shall be spaced so that all portions of a building or residence to <br />be protected are within a 250-foot radius of a hydrant.
