City of <br />Elk -�-� <br />RiVer <br />City of Elk River <br />City Council <br />Resolution 22- <br />A Resolution of the City Council of the City of Elk River Granting Final Plat <br />Approval for Olson Acres, Case No. P 22-08 <br />WHEREAS, application has been made for final plat approval, pursuant to Section 30-374 <br />of the Elk RiveY City Code of OYdinances, of the pYopeYt�r legally described on attached <br />Exhibit A and hereinafter referred to as "the PropertyT"; and <br />WHEREAS, a preliminar�T plat of the PropertyT was approved by the Cit�T Council on <br />SeptembeY 19, 2022; and <br />WHEREAS, the proposed final plat is consistent with the preliminary plat as approved byT <br />the CityT Council; and <br />WHEREAS, in October, 2015 the CityT commissioned a park dedication studyT prepared byT <br />HKGi Consulting to determine the impacts of development on the CityT's park s�Tstem. This <br />study `vas supplemented `vith an Appraisal stud�T prepared b�T Patchin Messner Valuation <br />Consultants in April 2016. The Cit�T's Park dedication ordinance `vas subsequentlyT amended, <br />in Ju1�T 2016, to reflect the findings of these studies and to incorporate park dedication fee <br />requirements that reflect the impacts of various t�Tpes of development on the need for the <br />acquisition, development and improvement of park land. The proposed development is a <br />residential development which will create park land acquisition, development and <br />improvement needs proportionate to the park dedication fee set byT the park dedication <br />ordinance; and <br />WHEREAS, the proposed final plat complies with each of the conditions set forth b�T the <br />Cit�T Council in its approval of the preliminar�T plat of the Propert�T; <br />NOW, THEREFORE, BE IT RESOLVED b�T the CityT Council of the CityT of Elk <br />River, Minnesota, as follows: <br />r�. The proposed subdivision is consistent `vith the Chapter of 30 of the City <br />Code of Ordinances and conforms with all of its requirements. <br />B. The proposed subdivision is consistent `vith all applicable general and <br />specialized city, count�r, and regional plans including, but not limited to, the <br />City's Comprehensive Plan. <br />C. The phyTsical characteristics of the site, including, but not limited to, <br />topographyT, soils, vegetation, susceptibility to erosion and siltation, <br />rowEREo er <br />���V�� <br />
