5. A Letter of Credit shall be provided to the city in the amount of 100% of the costs of the public <br />improvements. <br />Upon completion of all improvements and acceptance by the city, a security or warranty in a form <br />acceptable to the Public Works Director must be secured. <br />The Development Plan shall be approved by the Public Works Director prior to issuance of building <br />permits. <br />8. Staff approval of all plans prior to releasing the plat for recording. <br />9. All mailboxes shall be clustered. <br />10. Wetland impacts shall be reviewed and approved by the city and the appropriate state and federal agencies <br />prior to releasing the plat. <br />Background/Discussion <br />The subject property is 17.56 acres in size and located west of Fillmore <br />Street at the 178"' Avenue alignment. The property is zoned Single <br />Family Residential (R1-c) and the applicant is also requesting a Zone <br />Change (ZC 22-05) to PUD along with a Conditional Use Permit (CU <br />22-15) to develop a residential PUD consisting of detached villa style <br />homes. <br />The proposed preliminary plat includes 43 lots and three oudots. The <br />oudots are encumbered by overhead power lines, private access <br />easements, and wetlands which will not be developed in the future. <br />Comprehensive Plan <br />The subject site is guided for single-family residential uses. The plan <br />notes that higher densities (townhomes and duplexes only) along <br />primary transportation corridors and near existing areas of higher <br />density. The proposed project is consistent with the Comprehensive <br />Plan and develops the area at approximately 2.5 units/acre. <br />CR 12 <br />Public Utilities <br />Updated plans propose a private lift station to support sanitary services <br />for the four proposed lots on 187`h Court. The city has requested <br />additional information from the developer to support the proposed lift Figure i <br />station and demonstrate the need. Without a demonstrated need, staff will not support installation of a lift <br />station. The conditions included for approval of the PUD require staff approval of all plans. This condition <br />should be interpreted to provide staff authority to approve or deny the utility plans based on city standards and <br />their professional review and judgement. <br />Final Plat <br />The applicant requests approval of the final plat for the first phase of The Villas at Fillmore. This phase includes <br />28 buildable lots and four oudots. Outlots A and B include the access easement for the parcel to the west along <br />with a utility easement along the south 50 feet. These will not be replatted in the future. Oudots E and C include <br />future developable lots and will be replatted with future additions. <br />Park and Recreation <br />The Park and Recreation Commission reviewed the project on July 13, 2022, and recommended cash dedication <br />for the project. The developer spoke during the public hearing and outlined concerns regarding the cash <br />
