The easement <br /> provides access to the four properties north of the subject property. <br /> 4. The easement will need to provide that the grantor of the easement <br /> will be responsible for the construction, maintenance, and upkeep of <br /> the paved access drive across the subject property. <br /> 5. This approval shall not become final, and building permits will not be <br /> released, until the easement has been recorded. <br /> <br /> Motion carried 5-0. <br /> <br />5.4. City of Elk River <br /> Ordinance Amendment – Section 30-803(d), Keeping of Chickens, Case No. <br />OA 22-03 <br /> <br />Mr. Leeseberg presented the staff report. <br /> <br />Commissioner Rydberg asked for clarification about this amendment regarding <br />acreage for the number of chickens. <br /> <br />Mr. Carlton stated perhaps Commissioner Rydberg is thinking of a recent request to <br />create a tiered structure for allowing chickens on smaller lots, and neither the <br />commission nor the City Council were in favor of making any changes to the number <br />of chickens allowed, but what this amendment does is clarify the ordinance language <br />for the public’s understanding with parcels over 5 acres. <br /> <br />Chair Larson-Vito asked if there were complaints about roosters. <br /> <br />Mr. Carlton stated they received an occasional rooster complaint on properties that <br />were not allowed to have chickens in the first place. <br /> <br />Mr. Leeseberg explained why he brought it as part of this amendment and <br />reinforcing it only be allowed on parcels within the urban service district. <br /> <br />Commissioner Rydberg stated you have to have a rooster to have a laying hen for <br />eggs. <br /> <br />Mr. Leeseberg stated since adopting this ordinance, they have not had very many <br />chicken CUPs, so eggs are happening somehow. <br /> <br />Chair Larson-Vito opened the public hearing. <br /> <br />There being no one to speak, Chair Larson-Vito closed the public hearing. <br /> <br />Moved by Commissioner Beise and seconded by Commissioner Mauren to <br />recommend approval of the ordinance amendment by the City of Elk River for <br />Section 30-803(d), Keeping of Chickens, as outlined in the staff report. <br /> <br /> <br />
