Land Use Amendment from Single Family to Mixed Residential <br />Neighborhood, Case No. LU 22-01 <br /> B. Zone Change from R1b (Single Family Residential) to R2b (Residential), <br />Case No. ZC 22-03 <br /> <br />Mr. Leeseberg presented the staff report. <br /> <br />Chair Larson-Vito opened the public hearing. <br /> <br />Todd Olin, Landform, introduced himself on behalf of the applicant, Daniel <br />Kruger. He indicated the plans submitted followed the plans that were previously <br />submitted during the Concept Review phase. He updated the commission that the <br />road will now be paved, and sewer extension installed along the private road to the <br />north property line. He also noted they worked with an easement with Elk River <br />Municipal Utilities. <br /> <br />There being no one else to speak, Chair Larson-Vito closed the public hearing. <br /> <br />Commissioner Mauren asked about the current litigation with the owners of Wapiti <br />Campground. <br /> <br />Mr. Leeseberg stated that litigation is independent of this application and does not <br />include this property. <br /> <br />Moved by Commissioner Booth and seconded by Commissioner Mauren to <br />recommend approval of the request by Daniel Kruger amending the <br />Comprehensive Plan to change the land use from Traditional Single-Family <br />Residential to Mixed Residential as outlined in the staff report. <br /> <br /> Motion carried 5-0. <br /> <br />Moved by Commissioner Rydberg and seconded by Commissioner Booth to <br />recommend approval of the request by Daniel Kruger of an ordinance <br />rezoning certain properties from R-1b to R-2b for the following reason: <br />1. The rezoning is consistent with the City of Elk River Land Use Plan <br /> adopted as part of the City of Elk River Comprehensive Plan. <br /> <br />And with the following conditions: <br /> <br /> 1. The Land Use Amendment, to Mixed Residential (LU 22-01) shall be <br /> approved by the City Council. <br /> 2. The existing driveway along the east property line must be improved <br /> to city standards consistent with private streets <br /> 3. Staff approval of an easement providing perpetual, non-exclusive, <br /> cross access movement for vehicular and pedestrian traffic over the <br /> <br />
