Notices given in any other manner will be <br />deemed received only upon actual receipt. Unless Landlord specifies otherwise, rent will be <br />payable to Landlord at the address designated for notices from time to time. <br />ARTICLE 26. REPRESENTATIONS <br />Tenant acknowledges that, except as expressly stated in this Sub -Lease, Landlord has <br />made no representations, promises or warranties regarding the Demised Premises, Property, or <br />this Sub -Lease. <br />ARTICLE 27. NON -WAIVER <br />Acceptance of rent following a Default by Tenant, known or unknown to Landlord, <br />monetary or non -monetary, shall in all cases be deemed a matter of mitigating damages and not <br />a waiver of such Default. Forbearance for any length of time shall not be deemed a waiver by <br />Landlord. Landlord's rights can be waived only by a written express waiver particularly <br />stating the matter waived. No other act, statement, or omission of any kind by Landlord shall <br />be deemed a waiver of Landlord's rights. <br />-11- <br />
