PETER NEWLAND TO SELL POTTERY FROM HIS HOME AT 20140 VANCE <br />STREET, AND THAT THE HOURS OF HIS SALES BE RESTRICTED FROM 8:00 A.M. TO 10:00 <br />P.M., AND THAT MR. NEWLAND NOT BE ALLOWED TO HIRE MORE THAN ONE NON-RESIDENT EMPLOYEE, <br />AND THAT THE CONDITIONAL USE BE REVIEWED IN TWO YEARS. COMMISSIONER WARD SECONDED <br />THE MOTION. THE MOTION PASSED 6-0. <br /> <br />5. Consider Variance Request for Masonic Lodge #95 <br /> <br />Dennis Kongsjord, Master of the Lodge, was present for this item at the meeting. <br />Also present were Harold Warneke and Gary Gunderson. <br /> <br />Mr. Dennis Kongsjord indicated to the Planning Commission members that he was <br />requesting a variance to the number of commercial uses allowed within the Masonic <br />Lodge located at 633 Upland Avenue, N.W., in Elk River. Mr. Kongsjord further <br />indicated that the number of commercial uses which are allowed now within the <br />structure is one, and that the Masonic Lodge is requesting an increase up to <br />four uses. Mr. Kongsjord further indicated that the reason for the request is that <br />at the present time Industrial Health and Hygiene rents the entire office space, <br />and if they should decide to move out at some time in the future, the Masonic <br />Lodge People would have a hard time getting one person to occupy all of the space <br />in the building. <br /> <br />Mr. Harold Warneke indicated that at the present time there was a small amount <br />of office space available, and that the Masonic Lodge was intending to rent this <br />space to Lakeland Telecommunication. <br /> <br />Commissioner Pearce questioned whether there had been any traffic problems. Gary <br />Gunderson indicated that Industrial Health and Hygiene has been approached about <br />moving their trailers and that they had no problem with the request. <br /> <br />Chairman Tracy indicated that from previous meetings on the Masonic Lodge, he had <br />the idea that the people in the neighborhood were not too happy about businesses <br />being in the building, and further that he felt the neighboringresidentsh~d the <br />idea that the building was built mainly for lodge meeting purposes. <br /> <br />Rick Breezee, Building and Zoning Administrator, indicated that originally in 1977, <br />the Masonic Lodge was granted a zone change from R-l to C-l Commercial, and that <br />during this zone change meeting, a conditional use stipulation was given stating <br />that only one commercial user would be allowed for their building. Rick Breezee <br />further indicated that in 1980 the City of Elk River adopted a new land use and <br />zoning map and at that time changed the zone back to R-lC/Single Family, and by <br />doing this the Masonic Lodge became nonconforming. Rick Breezee further indicated <br />that the Masonic Lodge building was built with the intent of renting the building <br />from the start. <br /> <br />Gary Gunderson indicated that the reason for asking for four tennants is that in <br />the event Industrial Health and Hygiene left, they would have to go to multiple <br />tennants to get the rental to where the mortgage payments could be sustained. <br /> <br />Commissioner Pearce indicated that he was more concerned with the impact this <br />would have on the community. <br />
