regarding long-term safety and access for the site, especially as traffic patterns begin to change due to improvements
in Anoka, Ramsey, and Elk River. The platooning effect of cars moving through Elk River will cease, and gaps in
traffic will become harder and harder to find.
• The only structure that is used for ERX events/gathering/assembly is the chalet and that was brought up to code in
2016. I don't think that this should be listed in this way. It sounds like, you're going to send Bob out to inspect again
to add additional costs to the chalet that we already paid for? That's not fair what if your codes changed since
then. Not fair.
Along with the chalet, the Carlson Motorsports building, the shipping container viewing area, and the bridge over the
track entrance are also some structures used for gathering, assembly, spectators, viewing, and/or customers. It is
unclear what the structures on 75-110-1100 are used for.
I was told the chalet was brought up to mechanical and egress code but may need a restroom as it has a retail
component to it also. While the city tries to be helpful with guidance, our role is not to design and determine what is
required, this is what a registered architect would do for you, determine what requirements are needed per all the
codes, including ADA regulations.
Yes, it is saying these building/structures need to be reviewed by the Building Official for compliance. Fairness is
holding all commercial businesses to city and state regulations. As ERX is a bona fide commercial business, each
application for a building permit, and when required by the building official for enforcement of any provisions of
this article, two sets of plans and specifications shall be submitted. All plans and specifications, except for single-
family dwellings, or any other buildings exempted by Minnesota Statute or the Minnesota State Building Code, shall
be prepared and signed by a registered architect or a registered professional engineer duly qualified by registration as
required by Minn. Stats. 326.02. State statue 1300.0120 Subpart 4 outlines when permits shall not be required. As
you can see, every structure on site over 200 square feet requires a building permit, regardless of the use.
To get a better understating of all the functions on site is why I asked for a list of all structures, their current uses,
and what permits have been issued.
• Bullet point 9 — assuming the date will change if the map changes? Prior to CUP approval?
Correct
• Bullet point 14 — is this consistent with city code... or is this with the plans that I sent you? Keep in mind — those
plans were from two years ago and I'd like noted that the plans sent were an EXAMPLE of the type of sign that
could be used.
During our phone conversation I noted that we need to know the height, location, and size of changeable copy sign
so it would not be left open ended. Code allows up to 30 sgft without a CUP and all changeable copy signs must
comply with the standards set forth in Sec. 30-864 (e). A sign permit is required for all signs. The 70 sgft is based on
what you submitted. Please let me know if you have a desire for a larger changeable copy sign and we can update the
recommendation during the meeting.
• Clarification — I could still erect a VIP Viewing structure because it's listed as future on the map correct?
NK'hen/if the CUP is approved, yes, the VIP viewing structure can be constructed once a commercial building permit
has been issued. Does the memo indicate something otherwise?
