The applicant is seeking a CUP to operate a dog boarding facility. TheyT `vill be utilizing t�vo of their e�sting <br />outbuildings and have no plans of adding anyT additional structures for the business. The applicant also states there <br />is no need for outside storage as all animals, food, and accessories will be stored inside. Dogs will utilize the <br />fenced-in area (dog park) for exercise and to relieve themselves. <br />The hours of operation will be daily from 8:00 a.m. — 8:00 p.m. TheyT currentl�T host a maximum of 10 domestic <br />animal units but will be expanding in the futuYe to 14-16 domestic units. <br />Applicable Regulations <br />In approving a Conditional Use Permit, the council mayT impose such specific conditions �vith regard to the <br />development or operation of the proposed use as it considers necessar�T to satisf�T the seven standards set forth in <br />Section 30-654 and the requirements contained in this article and to promote compatibilit�T with and minimize anyT <br />potentially adverse effects upon adjacent properties, the neighborhood or the cityT. <br />The issuance of a Conditional Use Permit can be ordered on1�T if the use at the proposed location: <br />1. LVill not en�iingeT; injure o�• detTzlnentally affect the use and enjoylnent of othe��p� ope�fiy in the iminediate vicinity o�� the pul�lic <br />bealtb, safety, 7noTals, colnfoTfi, convenience or•geneT�al �a�elfare of tbe neigbbo�hood oa� the city. <br />Without conditions, the use might endanger, injure oY detrimentally affect the use and enjoyment of otheY <br />propertyT in the immediate vicinityT or the public health, safety, morals, comfort, convenience, or general <br />welfaYe of the neighborhood or the cityr. <br />As all propertyT o`vners in the cit�T are allo`ved six animal units without anyT permits, staff recommends a <br />condition stating no more than siY animal units shall be allowed outdooYs at one time. Additionally, no <br />dogs designated as dangerous or potentiallyT dangerous shall be allowed on site. <br />2. LVill l�e consistent 2a�ith tbe co�nprehensive plan. <br />The propertyT is guided for rural residentiaL The rural residential categoryT consists of large lot single- <br />familyT homes. This is the predominant residential tyTpe in the north of the citv beyond the Urban Service <br />Area. This land use primarily consists of planned residential subdivisions and lots located directly on <br />arterial roadway-s. This land use supports large lot residential development and allows commercial kennels <br />with approval of a CUP. The use will be consistent with the comprehensive plan. <br />Staff does not see a need to impose specific conditions to satisfy this standard. <br />3. LVill not i�npede the no��nal and or�eTly developynent and ilnpTove7nent of su�7 ounding vacantpropeT7y. <br />Except for a 40-acre parcel directl�T southwest of the subject property, the surrounding area is full�T <br />developed. The use will not impede the normal and orderlyT development and improvement of <br />surrounding vacant propertyT. <br />Staff does not see a need to impose specific conditions to satisfy this standard. <br />4. LVill ��e seTved adequately l�y and �a�ill not adve�sely affect essential pul�lic facilities and se�vices including streets, police and fiz e <br />pTotection, dyainage, yefuse disposal, �a�ater� and se�a�eT• systeyns, paTks and schooLs; and aa�ill not, in paT7iculay, �eate t�a�c <br />congestion or intey, ference avitb tza�c on adjacent and neighl�oTzng pu��lic thoroughfares. <br />The propert�T is adequatelyT served b�T these facilities and will not adverselyT affect essential public facilities <br />and services including streets, police and fire protection, drainage, refuse disposal, water and se`ver s�Tstems, <br />parks, and schools; and `vill not, in particular, create traffic congestion or interference `vith traffic on <br />adjacent and neighboring public thoroughfares. <br />
