This encroachment would be on proposed lots 2. 3. <br />6. 7. 10 and 11 in the proposed Proctor One Plat. The petitioners also <br />requested a 2 ft. variance on the 22 ft. minimum dwelling width required <br />within the City of Elk River. <br /> <br />COMMISSIONER MORTON MOVED TO RECOMMEND DENIAL OF THE 2 FT. <br />'rR~ aa 1"1'. Consider Preliminary Plat Review of Proctor One Plat by Moyer & Weicht <br />Investment Corporation/Public Hearing <br /> <br />Moyer and Weicht Investment Corporation of Elk River. Minnesota are <br />requesting preliminary plat review of the plat of Proctor One on Parcel A <br />in Section 28. Township 33. Range 26. <br /> <br />. <br /> <br />The petitioners indicated that the plat would consist of three 4 unit <br />townhouses. each of the dwelling units proposed to be on its own lot. <br />They further indicated that all 12 lots proposed in the plat would be <br />served by City sewer and water. and that the proposed road to access <br />those lots would be privately owned and maintained. The plat lies within <br />an R-2b zoned district. <br /> <br />COMMISSIONER KIMBALL MOVED TO RECOMMEND APPROVAL TO THE CITY COUNCIL OF <br />THE PLAT OF PROCTOR ONE WITH THE FOLLOWING STIPULATIONS: <br /> <br />1. THAT THE PRIVATELY OWNED LATERAL SEWER LINES BE PLACED IN AN <br />EASEMENT ALONG WITH PRIVATE DRIVE AND THAT EACH DWELLING UNIT STAY <br />WITHIN THE BOUNDARIES OF ITS LOT TO HOOK-UP INDIVIDUALLY TO THOSE <br />LATERAL WATER AND SEWER LINES. <br /> <br />2. THAT THE FINAL DESIGN OF THE WATER AND SEWER LINES BE APPROVED BY <br />CITY ENGINEER, TERRY. MAURER. <br /> <br />3. THAT THE PETITIONER GAIN APPROVAL FROM MPCA FOR EXTENDING THE SEWER <br />AND WATER LINES. <br /> <br />. <br /> <br />4. THAT THE TOWNHOUSE ASSOCIATION AGREEMENT AND MAINTENANCE AGREEMENT <br />BE ENTERED INTO FOR THE ROAD.. SEWER AND WATERLINES. <br /> <br />S. THAT A HYDRANT IS ADDED BETWEEN LOTS 2 AND 3 AS PER RUSS ANDERSON. <br />FIRE CHElF'S RECOMMENDATION.. <br />
