The <br />Building and Zoning Administrator indicated that because of this, Staff <br />is recommending that a reciprocal agreement be entered into and be <br />reviewed City Attorney. <br /> <br />Present representing this item were: Ken Barthel, Jim Powell and Skip <br />Sorenson. <br /> <br />Chairman Wilson opened the public hearing. There being no one for or <br />against the item, Chairman Wilson closed the public hearing. <br /> <br />The Building and Zoning Administrator indicated that the water line <br />shall be installed to City standards and specifications and that a <br />letter of credit should be obtained for this purpose. <br /> <br />COMMISSIONER BARRETT MOVED TO RECOMMEND TO THE CITY COUNCIL PRELIMINARY <br />AND PLAT APPROVAL FOR THE REPLAT OF LOT 3. BLOCK 1. ELK RIVER PLAZA 2ND <br />ADDITION (ELK RIVER PLAZA 3RD ADDITION) WITH THE FOLLOWING <br />STIPULATIONS: <br /> <br />1. THAT THE CITY ATTORNEY REVIEW THE RECIPROCAL PARKING AND DRIVE <br />AGREEMENT. <br /> <br />2. NO PARK DEDICATION FEES. <br /> <br />3. NO DEVELOPER'S AGREEMENT. <br /> <br />4. LETTER OF CREDIT BE OBTAINED BY THE CITY FOR THE WATER LINE. <br /> <br />5. THAT THE WATER LINE BE INSTALLED PER CITY SPECIFICATIONS. <br /> <br />COMMISSIONER FUCHS SECONDED THE MOTION. THE MOTION CARRIED 6-0. <br /> <br />6. Conditional Use Permit by Barthel Construction/Public Hearing <br /> <br />Chairman Wilson explained that Barthel Construction is requesting an <br />amendment to the Elk River Plaza PUD agreement to allow a car wash on <br />Lot 3, Block 1. Elk River Plaza 2nd Addition. <br /> <br />The Building <br />allowed 60 <br />original PUD <br />3. <br /> <br />and Zoning Administrator stated that the original agreement <br />units of apartments on Lot 3. He further stated that the <br />Agreement as amended to allowed office/retail uses on Lot <br /> <br />Discussion was held regarding whether a gas station <br />as an accessory use to the car wash and also <br />containers. It was noted that gas pumps were not <br />further that a full time attendant would be keeping <br />containers proposed. <br />Chairman Wilson opened the public hearing. There being no one for or <br />against the matter.
