<br />Page 2 <br /> <br />. <br /> <br />Elk River Planning Commission Minutes <br />September 22. 1987 <br /> <br />COMMISSIONER KIMBALL MOVED TO RECOMMEND TO THE CITY COUNCIL APPROVAL OF <br />THE VARIANCE REQUEST BY NORTHWESTERN BELL TELEPHONE COMPANY ON PROPERTY <br />LEGALLY DESCRIBED AS THE W-l/2 OF LOT 3. AUDITOR'S SUBDIVISION NO. 4 FOR <br />A 4 iT. ENCROACHMENT ON THE 40 FT. REAR YARD SETBACK TO ACCOMMODATE AN <br />ADDITION AND THAT THE ADDITION MATCH THE EXISTING BUILDING. COMMISSIONER <br />FUCHS SECONDED THE MOTION. THE MOTION CARRIED 6-0. <br /> <br />5. Variance Request by Ronald Ray/Public Hearing <br /> <br />Chairman Wilson explained that Mr. Ray is requesting two variances to <br />accommodate a carport. The first is a 7 ft. encroachment on the 25 ft. <br />sideyard setback required in an A-1/Agricultural zoned district. The <br />second variance Mr. Ray is requesting a 1.176 sq. ft. variance on the <br />1.000 sq. ft. maximum size of an accessory building. <br /> <br />The Building & Zoning Administrator stated that Mr. Ray proposes to <br />attach the two existing garages on his property with the carport. Mr. <br />Ray wishes to shelter a pontoon boat in the carport. <br /> <br />Mr. Ray explained the reason he needed the carport was that the existing <br />structures on his property are currently full and would not house <br />something as large as a pontoon boat. <br /> <br />. Chairman Wilson opened the public hearing. There being no one for or <br />against the matter. Chairman Wilson closed the public hearing. <br /> <br />Commissioner Fuchs indicated he was for the variance due to the <br />limitations from peat on the south end of Mr. Ray's lot. the only <br />alternative location for Mr. Ray's carport was directly in front of his <br />house. Chairman Wilson felt the proposed location was not an eyesore <br />and that the accessory building set so well in the proposed <br />location. <br /> <br />COMMISSIONER FUCHS MOVED TO RECOMMEND APPROVAL TO THE CITY COUNCIL FOR A <br />VARIANCE REQUEST BY MR. RONALD RAY FOR A 7 FT. ENCORACHMENT ON THE 25 FT. <br />SIDEYARD SETBACK TO ACCOMMODATE A CARPORT AND FURTHER RECOMMENDED <br />APPROVAL OF THE VARIANCE FOR 1.176 SQ. FT. ON THE MAXIMUM SIZE OF AN <br />ACCESSORY BUILDING. COMMISSIONER KROPUENSKE SECONDED THE MOTION. THE <br />MOTION PASSED 6-0. <br /> <br />6. Variance Request by Dean Bartlow/Public Hearing <br /> <br />Chairman Wilson explained that Mr. Dean Bartlow is requesting a 50 ft. <br />encroachment on the 300 ft. setback required from an agricultural <br />building to adjacent residences. <br /> <br />. <br />
