Preliminary Plat Review of River's Edge by Mel Beaudry/Public Hearing <br /> <br />Chairman Wilson noted that this item has been withdrawn at the <br />applicant's request. <br /> <br />6. Conditional Use Permit (Auto Repair and Used Car Sales) by George Duvall <br />Public Hearing <br /> <br />Chairman Wilson noted that this item has been withdrawn at the <br />applicant's request. <br /> <br />7. <br /> <br />Zone Change Request by Richard Cherrier/Public Hearing <br /> <br />8. <br /> <br />Zone Change Request by the City of Elk River/Public Hearing <br /> <br />9. <br /> <br />Zone Change Request by MonOT/Public Hearing <br /> <br />Items 7. 8. and 9 are all relating to connecting property and. therefore. <br />were discussed as one item. <br /> <br />Chairman Wilson noted that there has been a request for zone change for <br />three parcels of property owned by the City of Elk River. MnDOT and <br />Richard Cherrier. He stated the request is to zone the property to a <br />C-3a zone from a R-1b zone. It was noted that some of this property had <br />been in front of the Council at a previous date for a zone change and was <br />denied. <br /> <br />Zack Johnson. City Planner. presented the Commission with a memorandum <br />and briefly highlighted the memo. Mr. Johnson indicated he is <br />recommending denial of the zone change request for the following reasons: <br /> <br />1. Land Use Map illustrates this area as medium density residential. <br /> <br />2. There are currently 420-460 acres of highway commercial zoned land <br />of which only 30-45% is currently developed. <br /> <br />3. Spot Zoning. <br /> <br />4. The Growth Management Plan Task Force will be reviewing this and <br />submitting a recommendation for the City as a whole. <br /> <br />Mr. Richard Cherrier stated he owns 22 acres of the land in question. He <br />indicated that Highway commercial would be much better than multi-family <br />residential because multi-family does not sell. He also noted that <br />concerning the Commission's concern regarding signage on the highway; <br />this is a result of a poor sign ordinance not the zoning ordinance. Mr. <br />Cherrier stated that if the City expects to build a tax base. they must <br />allow development in the City that will sell. <br />
