<br />Planning Commission Minutes <br />August 28, 1990 <br /> <br />Page 8 <br /> <br />--- <br /> <br />e <br /> <br />Jeff Scheel was also concerned with the pathway running through their <br />property. He questioned if there would be restrictions as to what they <br />could do with their property because of the park plan. <br /> <br />Tim Keane explained the difference between a Comprehensive Plan and an <br />official map. He stated that the designation of a land use such as a <br />park, in the Comprehensive Plan is to be used as a guide and this does <br />not in any way inhibit a property owner's rights to the use of their <br />property. <br /> <br />Steve Kreger questioned if his mother decides to sell her property in <br />the near future, does this plan tell future buyers that the Ci ty has <br />identified this area for purchase in the distant future? He indicated <br />this will scare future buyers away which will decrease the value of <br />her property. He felt that she would not get adequate compensation <br />from the City for her property. Mr. Kreger stated that for personal <br />reasons he would not like to see her land designated as a park. <br /> <br />Jeff Scheel stated that he agrees that the City has to plan for the <br />future of Elk River. There are people like the Kregers who enjoy their <br />place in the country, who will have to accommodate others because of <br />the plan that the Planning Commission is considering. Mr. Scheel <br />questioned what rights the property owners have to stop this process. <br /> <br />e <br /> <br />Tim Keane, City Attorney, addressed his concern stating that there will <br />be a public hearing with the City Council on September 17 where <br />interested property owners or affected property owners have an <br />opportunity to voice their opinion or to offer written correspondence. <br />He indicated that the plan is putting owners on long term notice that <br />this is an area that has been intended for purchase in the distant <br />future. <br /> <br />Mrs. Maria Moody indicated she was opposed to the plan as they moved <br />out in the country to get away from people. She questioned if the City <br />would buy their property at real market value. <br /> <br />Tim Keane, City Attorney, stated that eminent domain settlements are <br />generally acquired for greater than the fair market value. <br /> <br />. <br />Jane Kreger was opposed to the plan as she was concerned with people <br />walking around her property and she thought it would be difficult to <br />keep people away from her house. She stated that they were not notified <br />of the public hearing. Pat Klaers, City Administrator, stated that <br />individual property owners are not notified individually because it is <br />a City wide plan. <br /> <br />. <br /> <br />Commissioner Schroeder stated that he understood the public's fears. He <br />explained that at one time, Sherburne County Wildlife Refuge was all <br />privately owned. The owners were forced to sell because it was decided <br />to make that land into a national refuge. He indicated there is no <br />guarantee that one's property is going to be protected forever. <br /> <br />Pat Klaers, City Administrator stated that by identifying the property <br />on the map, the City is notifying the public that when the property <br />
