<br />Planning Commission Minutes <br />January 23, 1990 <br /> <br />Page 5 <br /> <br />e <br /> <br />COMMISSIONER EBERLEY MOVED TO RECOMMEND TO THE CITY COUNCIL APPROVAL OF <br />THE PLAT OF BAILEY BECK ADDITION WITH THE FOLLOWING STIPULATIONS: <br /> <br />1. THAT FINAL APPROVAL OF STREETS, SEWER, WATER, GRADING AND DRAINAGE <br />BE AS PER TERRY MAURER, CITY ENGINEER, THAT THE APPROVAL IS PRIOR <br />TO FINAL PLAT APPROVAL OF THE PLAT. THIS SHOULD INCLUDE THE FINAL <br />PLAT REFLECTING ALL THE NECESSARY EASEMENTS TO ACCOMPLISH <br />UTILITIES. <br /> <br />2. THAT LOTS 2, 3 AND 4, BE GIVEN REASONABLE ACCESS TO THE CITY WATER <br />LINES BUT NOT BE FORCED TO HOOK UP TO THEM UNLESS DESIRED BY THE <br />OWNERS. <br /> <br />3. THAT FIFTH STREET GAIN AN ADDITIONAL 17 FOOT OF RIGHT-OF-WAY <br />THROUGH THE DEDICATION OF THIS PLAT. <br /> <br />4. THAT UPGRADING OF FIFTH STREET IS NOT REQUIRED AS PART OF THIS <br />PLAT APPROVAL. <br /> <br />e <br /> <br />5. THAT THE DEVELOPER GAIN APPROVAL OF ALL THE NECESSARY PERMITS FROM <br />OTHER AGENCIES SUCH AS: APPROVAL BY THE DNR FOR DRAINAGE <br />OUTLETTING TO LAKE ORONO, DEPARTMENT OF HEALTH APPROVAL FOR WATER <br />MAIN EXTENSION, AND APPROVAL FROM MINNESOTA POLLUTION CONTROL <br />AGENCY FOR SANITARY SEWER CONNECTION. <br /> <br />6. THAT THE CITY'S APPROVAL OF THIS PLAT IS CONTINGENT UPON DNR <br />APPROVAL OF THE TOWNHOUSE UNITS <br /> <br />7. THAT THE APPROVAL OF THIS PLAT IS CONTINGENT UPON THE ZONE CHANGE <br />FOR THOSE TOWNHOUSE UNITS BEING APPROVED BY THE CITY. <br /> <br />8. THAT TIPTON IS A 32 FOOT WIDE FACE OF CURB TO FACE OF CURB, URBAN <br />SECTION ROAD WITH CONCRETE CURB AND GUTTER AND A 7 TON DESIGN. <br />FINAL APPROVAL OF THESE STANDARDS AS PER TERRY MAURER, CITY <br />ENGINEER. <br /> <br />9. THAT THE DEVELOPER REIMBURSE THE CITY FOR ALL PLATING FEES PRIOR <br />TO COUNCIL FINAL PLAT REVIEW. THIS INCLUDES: $7,700 PARK <br />DEDICATION FEE, $750 FIRST SEALCOA'l'ING FEE FOR TIPTON AVENUE AND <br />THE ESTIMATED ENGINEERING COSTS, CITY ATTORNEY FEES AND STAFF <br />TIME, AS ESTIMATED BY STAFF. <br /> <br />10. THAT PRIOR TO RECORDING 'fHIS PLAT, AN $85,000 LETTER OF CREDIT <br />IN FAVOR OF THE CITY IS PROVIDED BY THE DEVELOPER FOR SECURITY ON <br />THE IMPROVEMENTS THAT THE CITY IS TO ACCEPT WITH THIS PLAT. <br /> <br />e <br /> <br />11. THAT STREET LIGHTS ARE PROVIDED ON THE CORNER OF UPLAND AND FIFTH, <br />TIPTON AND UPLAND, AND AT THE END OF THE CUL-DE-SAC ON TIPTON. <br />THE LIGHTS AND 'fHE INSTALLATION OF THEM TO BE PAID FOR BY THE <br />DEVELOPER, THE FEE FOR RUNNING THE LIGHTS TO BE PAID FOR BY THE <br />CITY. <br />
