<br />e <br /> <br />e <br /> <br />~ <br />e <br /> <br />Planning Commission Minutes <br />January 23, 1990 <br /> <br />Page 3 <br /> <br />6. z.QJ!~_~ban~e ReQu~st by _~ & D Development/P.H. <br /> <br />Steve Rohlf, Building and Zoning Administrator indicated the applicants <br />are requesting a zone change on a parcel of property from R-Ic/Single <br />Family Residential which would accommodate single family houses with <br />Ci ty sewer and water to R-2b/Townhouse Multifamily Residential. Mr. <br />Rohlf cautioned the Planning Commission to not consider what uses are <br />proposed by the petitioner (townhouses) but what uses could take place <br />under the proposed zoning designation. He explained the three reasons <br />when a zone change should be approved and when it is legal to approve a <br />request. <br /> <br />Commissioner Kimball opened the public hearing. <br /> <br />Norman Schamber of 551 Tipton was concerned wi.,th apartment buildings <br />being allowed in this area. Steve Rohlf, B & Z Administrator indicated <br />that apartments would be allowed in an R-2b zone. but still would only <br />contain up to four units per building. <br /> <br />Chairman Kimball closed the public hearing. <br /> <br />Commissioner Kimball asked staff that if it wasn't for the three unit <br />townhouse then we wouldn't have to go through the zone change. Mr. <br />Rohlf indicated that we would have to go through he zone change but the <br />developers would be asking for a R-2a instead of the R-2b. <br /> <br />Chairman Kimball indicated that it was his understanding that the DNR <br />was looking at eliminating one of the units. Steve Rohlf indicated that <br />the DNR was looking at whether they will approve 6 or 7 units fronting <br />the lake (a matter of density). Dennis Anderson indicated that the DNR, <br />without any problem, will allow 6.9 units. Mr. Anderson indicated that <br />for the .1 unit we will have to make concessions such as setbacks etc. <br />to satisfy the DNR. <br /> <br />After discussing this issue, it was the consensus of the Planning <br />Commission that they would like to go with R-2a zoning because of the <br />density, as this would be more restrictive. Steve Rohlf, Building and <br />Zoning Administrator, indicated that the petitioners have asked that <br />the R-2b be acted on. He indicated that the applicant would have to <br />agree to the R-2a zoning to be acted on at this time. <br /> <br />At this time a short recess was taken giving the applicants time to <br />consider the R-2a zoning. <br /> <br />Rick Foster and Dennis Anderson of Rand D development agreed to have <br />R-2a zoning also be considered. Staff suggested that this be submitted <br />to the City in writing. <br />
