Applicable Regulations <br />In approving a Conditional Use Permit, the council ma�T impose such specific conditions `vith regard to the <br />development or operation of the proposed use as it considers necessary to satisfy the seven standards set forth in <br />Section 30-654 and the requirements contained in this article and to promote compatibilit�J with and minimize any <br />potentiallyT adverse effects upon adjacent properties, the neighborhood or the cityT. <br />The issuance of a Conditional Use Permit can be ordered on1yT if the use at the proposed location: <br />LVill not endanger, injuye oz• det�zlnentally affect the use and enjoy�nent of otheT�pTopeTfiy in tbe ilnlnediate vicinity oT� the pul�lic <br />health, safety, 1no�als, co�nfozfi, convenience oT�general2a�elfaTe of the neigbl�orhood o�� the czty. <br />The surYounding uses include motoY vehicle sales, truck terminals, and industrial uses. The use tivill not <br />endanger, injure or detrimentally affect the use and enjoyment of other propert�T in the immediate vicinit�T <br />or the public health, safet�T, morals, comfort, convenience, or general welfare of the neighborhood or the <br />cit�T. <br />Staff does not see a need to impose specific conditions to satisf�T this standard. <br />2. LVill be consistent 2��ith the colnpr•ebensive plan. <br />The comprehensive plan guides the propernT for HighwayT Business. The highwayT business categoryT <br />primarily consists of a mix of auto-oriented retail and service businesses, restaurants, and communityT and <br />regional-scale shopping centers. Highway business uses are located along Highway 169 and Highway 10 <br />and have high visibilit�T from these corridors. The use will be consistent with the comprehensive plan. <br />Staff does not see a need to impose specific conditions to satisfyT this standard. <br />3. LVill not ilnpede the no��nal and o��e�ly develop�nent and i�nprovelnent of su��ounding vacantpropeT�y. <br />There are several vacant properties in the area, all of which can support similar uses. The use will not <br />impede the normal and orderlyT development and improvement of surrounding vacant propertyT. <br />Staff does not see a need to impose specific conditions to satisfy this standard. <br />4. LVill be se�ved adeguately l�y and �a�ill not adve�:sely affect essential pul�lic facilities and seTvices including streets, police and fi� e <br />p� otection, drainage, Tefuse dis�osal, 2a�ateT� and se�a�er� syste7ns, parks and schools; and 2a�ill not, in par7icular, cr�eate t� a�c <br />congestion or� inter, fez ence 2a�itb t� a�c on adjacent and neigh��oazna pu��lic thoa oughfa� es. <br />The properttT is located inside the urban service area and will utilize city services. The proposed use is not <br />expected to adversel�T affect public safettT or cit�T services. Traffic impacts are not expected to create excess <br />congestion or wear. Staff does not see a need to impose specific conditions to satisfy this standard. <br />5. LVill not involve uses, activities, pTocesses, �nate�zal�; equ pinent and conditions of ope�ation tbat aa�ill be det�zlnental to any <br />pe�sons or•pr•ope��y l�ecause of excessive t�a�c, noise, s�noke, fulne�; glare, odo�s, dust o�• vil�Tations. <br />The pYoposal consists of office space use and seveYal paYking stalls in the e�sting parking lot The use will <br />not involve uses, activities, pYocesses, materials, equipment and conditions of opeYation that will be <br />detrimental to an�T persons or propert�T because of excessive traffic, noise, smoke, fumes, glare, odors, <br />dust, or vibrations. <br />Staff does not see a need to impose specific conditions to satisfyT this standard. <br />
