<br />Page 30 <br /> <br />. <br /> <br />Steve - I want to make a couple of things perfectly plain to you, Gerry, as <br />long as this is being recorded. One is, that when you get a building permit <br />that it addresses grading, so that when you do it prior, you did it without <br />any permission whatsoever. Gerry - Whats that now. Steve - Grading - you <br />can do grading on lots as part of the building permit issuance and it can be <br />addressed at that time, for adding fill and stuff like this. Doing it prior <br />to the building permi t is one of the reasons why you have so many problems, <br />because it wasn't addressed period. Otherwise you would have been told not <br />to do half the things that happen here. Also, this pond at the end of Royal <br />Oaks (I want this on the record) so you can't say you never heard it. That <br />pond is a designated water way protected by the Army Corps of Engineers. It <br />looks like a grassy swamp, but it is protected. Any fill that goes in there <br />without their permission, is illegal. They will prosecute so make sure you <br />are careful dumping fill in there. Its the one right there Cliff, behind <br />your office. I want that on record so he can't claim ignorance on that <br />one. Also, I think, what the City did was give us a plan that is accessible <br />on how to correct this. You can see how it is hard for us to sort through <br />what agreement was made with who and who does it. <br /> <br />Cliff - You bet! <br /> <br />. <br /> <br />Steve - So, somewhat you have to watch out for yourself also, and people <br />with trees and stuff like that, I don't anticipate the City, if you have <br />damage to your trees, pursuing that you may have to do that on your own also. <br /> <br />Cliff - The biggest issues to on Lots 6, 7, 8, 9, & 10 - I just received a <br />call from a gentlemen that owns lot 10 that there were a lot of trees that <br />were buried underneath these soils that were brought in. I know, that on <br />three of them right now there is a lot of trees in there. Before the <br />retaining walls can be built those trees have to be removed otherwise these <br />retaining walls are not going to do any good once those trees start decaying <br />and the soils start falling down. <br /> <br />Steve - As per the approval of Deerfield 3rd and 4th, trees can only be <br />buried if part of the approval process through the plat in designated areas <br />that are protected with easements. So any burying of trees on individual <br />lots is prohibited. So that is something else that is on the record! Do <br />not bury any trees in Deerfield 3rd or 4th or any place else in the City, <br />unless you have an approved location. That is something that comes back to <br />haunt somebody ten years later when they put up a garage upon it, no one <br />knows that it is there. <br /> <br />Gerry - I'm not aware of any trees being buried. <br /> <br />Steve - I guess one guy had pictures of it. <br />pictures. <br /> <br />Someone indicated they had <br /> <br />. <br /> <br />Gerry - For years and years (3 years) we have had a burial area up in the <br />park. Now were burying stuff down in the back of the lot down in Royal Oaks <br />as we have no place to get rid of the stuff. There is a burial area in <br />Royal Oaks. <br /> <br />Steve - Was that approved through the platting process, Gerry? <br />
