You may well be <br />advised Jim, (especially you Jim) for an example, you may want to talk to <br />your own attorney about your trees and that sort of situation. We are not <br />going to guarantee the City is going to get into that one...you may want to <br />pursue that on your own. <br /> <br />Jim - I just want to make sure I understand, is my lot involved at all in <br />what is being address here because they may have to come on there. <br /> <br />Steve - Are these existing slopes or corrected slopes? <br /> <br />Cliff - Those are existing slopes. <br /> <br />Steve - If they went on his lot they should expand the plans to expand this. <br /> <br />Cliff - He is showing a 4 to 1 slope on there right now, I feel if Gerry <br />went in on your property and took your soil that would be between you and <br />Gerry. What I'm looking for is erosion and one of the things Jim, this lot <br />19 next to yours is the biggest thing on there is if this is going to be <br />compatible with your property. If Jerry did take soils off it is going to <br />be between you and Gerry. <br /> <br />Steve - If he had gone on your property and took dirt off to where it left a <br />cliff then we would want it addressed here because it would be contrary to <br />the ordinance. If he trespassed on your property and took dirt, he would be <br />well advised to contact your attorney and pursue civilly. <br /> <br />Cliff - Were there trees buried on that property, Gerry (Lot 19). <br /> <br />Gerry, I don't know, there may have been some brush. I'm not sure because I <br />wasn't there all the time, but when we go in there and the guy does his <br />excavating it won't take long to find out because their going to be coming <br />in here for building permits soon. <br /> <br />Cliff - I'd get a hold of Mr. Stinger then. Are there any other questions <br />on the first one, Lot 14? <br /> <br />Bill Oakers with Howard Bohanan Homes - When will we be able to get a permit <br />on that. <br /> <br />Cliff - What I can do on something like that.. what we need is an guarantee <br />as far as its going to be done, especially on Lot 14, because the majori ty <br />of this really addresses Lot 3 and Lot 14. We have a verbal agreement that <br />Gerry is going to get it corrected. What I'm going to be requiring is that <br />the corrections are done prior to October 1st and no Certificate of <br />Occupancy is going to be issued, so its going to be up to you and Gerry as <br />far as achieving it. I can issue a permit providing you follow the <br />guidelines that has been illustrated here as far as elevation of the house, <br />the types of house. As far as the silt fencing, it should be done prior to <br />construction, so that all of this stuff is slowed up and taken care of. As <br />far as the retaining walls, the top soil, the blanketing has to be done <br />prior to a Certificate of Occupancy. <br />
