<br />. <br /> <br />. <br /> <br />. <br /> <br />Planning Commission Minutes <br />April 23, 1991 <br /> <br />Page 14 <br /> <br />COMMISSIONER SCHROEDER MOVED TO RECOMMEND TO THE CITY COUNCIL DENIAL OF <br />THE VARIANCE REQUEST BECAUSE THE PLANNING COMMISSION VIEWED THE <br />SKYLIGHT AS AN ORNAMENTAL TOWER, THEREFORE, IT IS A NON-ISSUE. <br />COMMISSIONER NADEAU SECONDED THE MOTION. THE MOTION CARRIED 6-0. <br /> <br />19. Consider Conditional Use Permit (New Cburch by Church of St. <br />Andrew/P.H. <br /> <br />This item was not reviewed by Ms. Szklarski because of the lateness of <br />the meeting but was left open for discussion. <br /> <br />Chairperson Johnson opened the public hearing. <br /> <br />Larry Toth stated that they were in agreement with most of staff's <br />recommendations except stipulations 2 and 4. Mr. Toth felt that the <br />temporary classrooms were a separate issue and, therefore, should not <br />be part of this process. Mr. Toth addressed the traffic issue of <br />accessing off of Irving Avenue. He stated that they plan to have an <br />exi t-only in this location because of the school and the large, old <br />trees that would have to be removed. The church is in the process of <br />trying to acquire the parcel of land to the east between Gates Avenue <br />and the church property so that they would have an access off of Gates. <br /> <br />Mr. Shirts felt that an access off of Irving Avenue would be <br />detrimental to the children as the playground is in that area. <br /> <br />Landscaping was also briefly discussed. Ms. Szklarski, stated that she <br />had been out to the site and they do meet the landscaping requirements. <br /> <br />COMMISSIONER NADEAU MOVED TO RECOMMEND TO THE CITY COUNCIL APPROVAL OF <br />THE CONDITIONAL USE PERMIT REQUEST BY ST. ANDREW'S CHURCH TO CONSTRUCT <br />A NEW CHURCH FACILITY SITING STAFF'S MEMO REGARDING THE FINDINGS OF <br />FACT INCLUDING THE FOLLOWING STIPULATIONS: <br /> <br />1. THAT NO VARIANCE IS NEEDED FOR THE HEIGHT OF A SKYLIGHT. <br /> <br />2. THAT THE PARKING LOT BE HARDSURFACED WITH CONCRETE CURB AND <br />GUTTER. FURTHER, THAT THE NUMBER OF PARKING STALLS BE DETERMINED <br />BY THE CITY COUNCIL. <br /> <br />3. THAT THE NINE STANDARDS FOR LIGHTING, AS SHOWN ON THE SITE PLAN, <br />BE PROVIDED IN THE PARKING LOT. FURTHER, THAT THE STANDARDS BE <br />INCREASED TO THREE FOOT CANDLES WITHIN THE LOT. <br /> <br />4. THAT THERE BE AN EXIT-ONLY OFF OF IRVING AVENUE. <br /> <br />5. THAT THE APPLICANT WORK WITH THE ELK RIVER MUNICIPAL UTILITIES IN <br />RELOCATING THE ELECTRIC LINE. <br /> <br />6. THAT A CASH SURETY IN AN AMOUNT TO BE DETERMINED BY THE CITY <br />ENGINEER BE REQUIRED FROM THE CONTRACTOR PRIOR TO OPEN CUTTING 4TH <br />STREET. RESTORATION OF 4TH STREET SHOULD BE A MINIMUM OF 5 INCHES <br />OF AGGREGATE BASE AND 2-1/2 INCHES OF BITUMINOUS. SAID <br />RESTORATION SHOULD BE COMPLETED WITHIN 72 HOURS OF OPEN CUTTING. <br />
