" <br /> <br />~JdUjU~U@U <br /> <br /> <br />Page 3 <br /> <br />REQUEST MEETS THE SEVEN STANDARDS FOR GRANTING A CONDITIONAL USE PERMIT. <br />APPROVAL IS RECOMMENDED WITH THE FOLLOWING CONDITIONS: <br /> <br />FINAL PLAT BE APPROVED BY THE CITY COUNCIL AND RECORDED WITH SHERBURNE <br />COUNTY. <br /> <br />ALL CONDITIONS STATED IN RESOLUTION NO. 93-81 BE COMPLETELY SATISFIED. <br /> <br />A DEVELOPMENT AGREEMENT AND PUD AGREEMENT FOR ELK PARK CENTER PUD BE <br />APPROVED BY THE CITY COUNCIL. <br /> <br />PLANS BE REVISED IN ACCORDANCE WITH LETTERS FROM STEVE ACH DATED MARCH <br />24,1994, AND TERRY MAURER, DATED MARCH 22, 1994. <br /> <br />ALL RETAINING WALLS SHOULD BE CONSTRUCTED OF A DECORATIVE BLOCK THAT IS <br />COMPATIBLE WITH THE SHOPPING CENTER. <br /> <br />THE NUMBER OF SEMI TRUCKS PARKING WITHIN THE SERVICE AREA BEHIND THE <br />SHOPPING CENTER SHOULD NOT EXCEED THE NUMBER OF LOADING BERTHS. <br /> <br />ALL LANDSCAPED AREAS BE FULLY IRRIGATED WITH UNDERGROUND IRRIGATION. <br /> <br />A TEN (10) FOOT WIDE BITUMINOUS TRAIL BE CONSTRUCTED ALONG THE EAST SIDE <br />OF JACKSON ROAD. <br /> <br />A SIX (6) FOOT WIDE CONCRETE SIDEWALK BE CONSTRUCTED ALONG BOTH SIDES OF <br />FREEPORT AVENUE. <br /> <br />THE SIGN PACKAGE FOR THE FIRST PHASE OF ELK PARK CENTER PUD MAY INCLUDE A <br />DEVELOPMENT SIGN ALONG HIGHWAY 169, A 128 SQUARE FOOT MONUMENT STYLE <br />SIGN AT FREEPORT AVENUE AND JACKSON ROAD, AND A 6 FOOT HIGH BY 4 FOOT <br />WIDE MONUMENT STYLE SIGN IDENTIFYING TARGET AT THE REAR ENTRANCE OFF OF <br />JACKSON ROAD. <br /> <br />11. ALL PLANS BE REVISED IN ACCORDANCE TO THESE CONDITIONS AND PREVIOUS <br />LETTERS, AND SUBMITTED FOR APPROVAL BY STAFF PRIOR TO ISSUANCE OF A <br />BUILDING PERMIT. <br /> <br />COMMISSIONER EBERLEY SECONDED THE MOTION. THE MOTION CARRIED 6-0. <br /> <br />Commissioner Eberley stated that she wanted it made part of the record that great care <br />should be taken regarding grading and tree preservation. Steve Ach and Terry Maurer <br />reviewed the erosion control plan. Also, Commissioner Eberley stated that the Planning <br />Commission would like more detailed information included in the packets (such as a <br />copy of the PUD Agreement, a copy of the Developers Agreement, etc., whenever <br />applicable) when considering items this complex in nature <br /> <br />4. <br /> <br />. <br /> <br />Other Business <br /> <br />Commissioner Eberley asked staff if the Planning Commission (or a representative <br />of the Commission) could be included in the Site Plan Review process. Steve Ach <br />explained the process and the individuals that make up the committee. <br />
