In the A-1 zone, where the <br />minimum lot size is ten acres, a person could have a 10 to 15 acre platted <br />parcel and still be required to obtain a conditional use to have horses and the <br />neighbor, with only 5.5 acres of unplatted property, could have horses as a <br />permitted use. To a lesser extent, the same type of situation could also happen <br />the R 1 a zone; two neighbors could have similar sized parcels and if one is <br />platted and the other is not, the unplatted lot could have a horse as a <br />permitted use and the platted lot would require a conditional use permit. <br /> <br />Chair Dillon opened the public hearing. There being no comments for the <br />public, Chair Dillon closed the public hearing. <br /> <br />COMMISSIONER THOMPSON MOVED THE PLANNING COMMISSION RECOMMEND <br />APPROVE OF THE REQUEST BY CITY OF ELK RIVER FOR ORDINANCE AMENDMENT <br />(SETBACK REQUIREMENTS FOR BUILDINGS AND FENCES RELATED TO AGRICULTURAL <br />USES), PUBLIC HEARING CASE NO. OA 96-6 AND REQUEST BY CITY OF ELK RIVER <br />FOR ORDINANCE AMENDMENT (PLATTED/UNPLATTED RELATED TO AGRICULTURAL <br />USES), PUBLIC HEARING CASE NO. OA96-5, BASED ON THE FINDINGS IN THE STAFF <br />REPORT AND THE FACT THERE WAS NO OPPOSITION DURING THE PUBLIC HEARING, <br />TO APPROVE THE CODE AMENDMENTS AS PRESENTED IN THE ATTACHED <br />ORDINANCE AND TO AMEND THE 30 FOOT SETBACK TO 5 FEET FROM THE REAR OF <br />THE HOUSE AND THEN 10 FEET FROM THE REAR OF THE HOUSE FORWARD AND <br />REDUCE 10 ACRE DOWN TO LOT SIZE OF 5 ACRES. <br /> <br />COMMISSIONER SULLIVAN SECONDED THE MOTION THE MOTION CARRIED 6-0. <br /> <br />Staff report by Scott Harlicker. The City of Elk River is requesting to amend <br />Section 900.03 and Section 900.12 of the City Ordinance relating to definitions, <br />light industrial uses, medium industrial uses and highway commercial uses. <br /> <br />The purpose of the 1-1 District is to serve as a transition between more industrial <br />uses, residential and other business uses. The district is appropriate for <br />manufacturing, warehousing and similar industrial uses. The industries should be <br />compatible with each other and with surrounding land uses. The 1-2 District, on <br />the other hand, is intended to accommodate more intense manufacturing and <br />processing than would be allowed in the 1-1 District. These uses may tend to <br />generate more off-site impacts than those allowed in the 1-1 District. <br /> <br />In an attempt to develop a list of allowable uses that better reflect the stated <br />purposes of the two industrial districts, staff reviewed other ordinances and <br />incorporated some of the uses found in those ordinances with uses found in Elk <br />River's ordinance. The result can be found in the following list of suggested <br />allowed uses. <br /> <br />Commissioner Minton suggested relabeling 1-2 to heavy manufacturing rather <br />than medium manufacturing. <br /> <br />. <br />
