There is an <br />underground stream running through the property which required that the <br />home crowd the west lot line. <br /> <br />Chair Dillon opened the public hearing. There being no comments for the <br />public, Chair Dillon closed the public hearing. <br /> <br />Commissioner Minton is not impressed with extending the deck 2 feet just to see <br />the children on the other side. Commissioner Thompson does not like the idea. <br />Commissioner Thompson does not think this request is a hardship. Commissioner <br />Dillon would like to see the tree kept in the plans. <br /> <br />COMMISSIONER MINTON MOVED THE PLANNING COMMISSION RECOMMEND <br />APPROVAL OF THE REQUEST BY STEPHEN ROHLF REQUEST FOR SETBACK VARIANCE, <br />PUBLIC HEARING CASE NO. V 96-3, BASED ON THE FINDING IN THE STAFF REPORT <br />AND THE FACT THERE WAS NO OPPOSITION DURING THE PUBLIC HEARING SUBJECT <br />TO AMENDING STAFF'S RECOMMENDATION TO APPROVING ONLY THE 5 FOOT SIDE <br />YARD SETBACK. COMMISSIONER THOMPSON SECONDED THE MOTION. THE <br />MOTION FAILED 3-3. Chair Dillon, Commissioners Anderson and Minton <br />opposed. <br /> <br />COMMISSION SULLIVAN MOVED THE PLANNING COMMISSION RECOMMEND <br />APPROVAL OF THE REQUEST BY STEPHEN ROHLF FOR SETBACK VARIANCE, PUBLIC <br />HEARING CASE NO. V 96-3 AND FOR A VARIANCE TO ALLOW A 5 FOOT SIDE YARD <br />SETBACK AND A 28 FOOT FRONT YARD SETBACK FOR THE PURPOSE OF EXPANDING <br />THE EXISTING DECK, BASED ON THE FINDING IN THE STAFF REPORT AND THE FACT <br />THERE WAS NO OPPOSITION DURING THE PUBLIC HEARING. COMMISSIONER <br />THOMPSON SECONDED THE MOTION. THE MOTION CARRIED 4-2. Commissioner <br />Thompson and Minton opposed. <br /> <br /> <br />staff report by Scott Harlicker. Scott stated Cargill has requested the item be <br />tabled. Staff doesn't have a problem tabling this item based on Cargill's <br />request. <br /> <br />COMMISSIONER MINTON MOVED TO TABLE THE REQUEST FOR ZONE CHANGE <br />FROM R1A TO 1-1 PUBLIC HEARING CASE NO. ZC 96-10. COMMISSIONER <br />ANDERSON SECONDED THE MOTION. THE MOTION CARRIED 6-0. <br /> <br />COMMISSIONER MINTON MOVED TO AMEND THE AGENDA TO ADD <br />INFORMATIONAL BACKGROUND FROM CARGILL. COMMISSIONER KUESTER <br />SECONDED THE MOTION. THE MOTION CARRIED 6-0. <br /> <br />Tim Thomas, Attorney for Cargill; Dave Cieslak, Ph.D-Feed Division; and Rita <br />Schmahl, Feed ANC Operations Manager, were in attendance to present <br />informational background on the Cargill Animal Nutrition Center.
