20. DISCIPLINE, DISMISSAL & LAY OFF <br />.The Utilities retains the right to take disciplinary and other action as it <br />believes appropriate to manage employee performance and workplace conduct. The <br />nature andseverity of the issue and the circumstances as a whole. <br />Examples of discipline and other action that may be taken to manage performance and <br />workplace conduct include, but are not limited to: <br />Documented Coaching and Counseling <br />Oral reprimand <br />Written reprimand <br />Performance Improvement Plan <br />Suspension <br />Demotion <br />Termination. <br />Discipline and other action may be used in any order or combination in the discretion of <br />the Utilities. In some cases, one or more disciplinary actions will be taken before <br />termination; in other cases, termination will be immediate. <br />While the Utilities strives for consistency, the level of discipline taken in any given case <br />does not establish a controlling precedent for futurecircumstances. <br />.All new employees shall be on probation for a period of <br />one hundred eighty (180) days. Continued employment during this period shall rest <br />solely with the discretion of the Utilities Commission. After that period, the employee <br />shall attain regular status subject to the following: <br />Employees on regular status may be dismissed only for cause, which may <br />include, but is not limited to, the following: Conduct in violation of or <br />inconsistent with Utilities policy, including but not limited to any and all <br />policies set forth in this Handbook; conduct or language that is improper <br />or inappropriate in the discretion of the Utilities; insubordination; failure <br />to do the work assigned in a manner satisfactory to the Utilities;dishonesty <br />or stealing; and the sale, transfer of, or possession, or being under the <br />influence, of intoxicating beverages or controlled or mood altering <br />substances while on the job. <br />.The Utilities reserves the right and sole discretion to <br />eliminate positions and/or reduce the hours associated with a position for any legitimate <br />business reason, with or without cause. <br />18 <br />April 2021 <br />93 <br />
