MnDOT Contract No.: 1046508 <br />3.8. Bridge No. 71019, No. 71018, No. 71017, and No. 71016. The State will share ownership responsibilities <br />with the City. The State will be listed as the owner in the NBIS (National Bridge Inspection Standards) <br />database. The State will perform or contract bridge inspections and major bridge maintenance. The City <br />will be responsible for all minor maintenance and local roadways (except those items identified below, <br />which are the State's responsibility). <br />A. City Responsibilities. The City will be responsible for minor maintenance, which includes all non- <br />structural maintenance activities on the bridges. The City will keep the roadway and bridge reasonably <br />clear from ice, snow, litter, and debris and undertake proper and timely cleaning and ice and snow <br />control measures when necessary; and keep the pedestrian walkways/shared use paths free and clear <br />from ice, snow, litter and debris, in accordance with ADA standards. Ice, snow, litter, and debris <br />removal will cover the entire bridge width without pushing ice or snow onto any roadway, railroad, <br />shared use path or walkway below the bridge. The City will be responsible for pavement markings, <br />guardrail on the local roadway, graffiti removal that is visible from the local roadway, and non - <br />structurally supported signing. The City will be responsible for oversize, overweight and special use <br />permits. <br />Future replacement of the bridges will be in accordance with the Cost Participation Policy. <br />B. State Responsibilities. The State will perform or contract structural inspections and major maintenance <br />of the bridges. Major maintenance includes all structural related maintenance, including expansion <br />joint flushing, deck crack sealing, painting, overlays, re -decking and rehabilitation of the bridge, <br />concrete bridge approach panels, and structurally -supported signing on the bridge. <br />The State is responsible for maintenance of all guardrails on T.H. 169 below the Bridges. Maintenance <br />of any roadway signing that is attached to the bridges, for the purpose of the roadway traffic on T.H. <br />169. Maintenance of all non -ornamental fencing on the Trunk Highway Right -Of -Way. Maintenance of <br />graffiti removal within the control of access below the Bridges. The State will determine the safe load <br />rating for the bridges. The State will provide emergency response for traffic hits and restitution from <br />insurance companies or private parties who have damaged the bridges. <br />The State retains its authority to administer, issue, and regulate access permits, sign advertising <br />permits, drainage permits, flag installation, and permits to install utilities on Trunk Highway Right -Of - <br />Way. <br />C. Aesthetics. Maintenance and repair of aesthetic elements on Bridges: metal emblem, concrete emblem <br />architectural concrete texture (fieldstone), ornamental metal railing, and any elements later added to <br />the bridge as a plan change by Section 2.3. Maintenance and repair includes, but is not limited to, <br />painting graffiti removal, replacement, and any other maintenance activity necessary to perpetuate the <br />aesthetic elements in a safe, usable, and aesthetically acceptable condition. <br />3.9. Additional Drainage. No party to this Agreement will drain any additional drainage volume into the storm <br />sewer facilities constructed under the construction contract that was not included in the drainage for <br />which the storm sewer facilities were designed, without first obtaining written permission to do so from <br />the other party. <br />3.10. Release and Conveyance of Roadways. Upon completion of the Main Street, Dodge Avenue NW, Dodge <br />Street NW, Jackson Avenue NW, 193rd Avenue NW, and 1971" Avenue NW construction, the State will serve <br />upon the City a "Notice of Release" placing those roadway portions under the jurisdiction of the City; and <br />subsequent thereto, after all required documents have been prepared and processed, the State will <br />convey to the City all right, title and interest of the State in those roadway portions.
