Motion carried 5-0. <br /> <br />7.2 Conditional Use Permit: Home Occupation for Tractor Trailer <br />Parking, Byron Nielson, 19796 Tyler Street <br /> <br />Mr. Leeseberg presented the staff report. <br /> <br />Mayor Dietz opened the public hearing. <br /> <br />Byron Nielson, 19796 Tyler St., stated he was in attendance as the applicant. <br /> <br />Wade Arntson, owner of parcel 75-471-0166, stated he had no problem with the <br />trailer on Mr. Nielson’s property. <br /> <br />Mayor Dietz closed the public hearing. <br /> <br />Councilmember Wagner confirmed the complaint had come through code <br />enforcement. <br /> <br />Councilmember Westgaard added that there have been a few similar situations in the <br />vicinity regarding an owner operator parking their vehicle on the property. Acquiring <br />a CUP would hopefully reduce future phone calls of code enforcement issues. <br /> <br />Moved by Councilmember Westgaard and seconded by Councilmember <br />Christianson to approve the Conditional Use Permit with the following <br />conditions to satisfy the standards set forth in Section 30-654: <br />1. Only one employee and one tractor and trailer are permitted <br />2. The tractor and trailer shall be parked on an approved surface per the <br />ordinance requirements. <br />3. The idling of a truck tractor in excess of 15 minutes from April 16 through <br />October 31, and 30 minutes from November 1 through April 15, is <br />prohibited. <br />4. Any future permits required for the home occupation shall have full <br />compliance with all commercial building, electrical, plumbing, and fire <br />code requirements.
