<br />9.42 Decisions. The Board shall arrive at a decision on such appeal <br /> <br />Concitional Use or Variance within~ reasonable period of time. <br /> <br />In Jassing upon an appeal the Board may, so long as such action <br /> <br />is in conformity with the provisions of this Ordina4ce, reverse <br /> <br />or affirm, wholly or in part, or modify the order, :r-equirement, <br /> <br />decision, or determination appealed from and it shall make its <br /> <br />decision in writing setting forth the findings of fact and the <br /> <br />reasons for its decisiom;, the Board shall submit their recommendaticns <br /> <br />to the City Council who shall make the final deterrrrLnation as <br /> <br />defined in the City Zoning Ordinance. In granting a Variance <br /> <br />the Board may prescribe appropriate conditions and ~;afeguards, in <br /> <br />addition to those specified in SectIori6. 55, wIrfch <br /> <br />are in conformity with the purposes of this Ordinance. Violations <br /> <br />of s,lch conditions and safeguards, when made a part of the terms <br /> <br />under which the Conditionsl Use Permit or Variance is granted, <br /> <br />shall be deemed a violation of this Ordinance punisr~ble under <br /> <br />Section 11.0. A co~ of all decisions granting Variances or <br /> <br />Cond~tional Use Permits shall be forwarded to the Commissioner <br /> <br />of Natural Resources within ten (10) days of such action. <br /> <br />9.43 <br /> <br />(For use by municipalities) <br /> <br />City Council <br />(governing body) <br />Appeals from any decision of the Board <br /> <br />Appeal to the <br /> <br />and District Court. <br /> <br />may be taken by any person or persons, jointly or sEverally, <br /> <br />aggr:.eved by any decision of the Board, or any taxpayer, <br /> <br />officer, department, board, or bureau of the ~cipality, to <br /> <br />the City CO:t.m.Cil,.," .
