Minnesota Counties. All stakeholders worked cooperatively to create a framework that would <br />allow work for the state and local governments, foster collaboration and accountability, and be <br />available to focus on the areas where the most harm is occurring. The agreed upon framework <br />will be memorialized in a Minnesota Opioids State-Subdivision Memorandum of Agreement <br />(“State-Subdivision Agreement”). <br />Some Key principles of this Agreement are as follows: <br />1. Financial Allocation: <br /> <br />a. 75 % of money will go to Local Government Units (“LGU”); 25% to the State <br />b. Of the LGU share, 81% will go to counties, 12.11% to Litigation Cities/Health <br />Department Cities; 6.74 % to cities with populations over 30,000 that have not <br />litigated. <br />c. If the State get full bonuses for maximum participation, this will be appx. <br />$180,161.790.43 for LGUs. <br />d. Payments will be made directly to local governments, beginning as early as April, <br />2022. Pursuant to the national settlement, these payments will be funded over 18 <br />years. <br /> <br />2. Up to 7% of the local government share will be reserved for private attorneys’ fees. <br />Attorneys will be required to seek reimbursement through the federal settlement first. <br />Unused funds will be returned to local governments for redistribution. <br /> <br />The City of Elk River will not receive a direction allocation pursuant to the State-Subdivision <br />Agreement, but Sherburne County will receive an allocation. <br />In order for staff to initiate formal settlement approval, the the Council must approve <br />participation in the Opioid Litigation Settlements and the State-Subdivision Agreement. Staff <br />and legal counsel recommend approval of the settlement and adopting the attached <br />Resolution, which will maximize funds for the County and the State. <br />Further information is provided in the attached materials from the League of Minnesota Cities <br />and the Minnesota Attorney General’s Office. <br /> <br />2 <br /> <br />
