"Structure" shall mean anything constructed or erected on the ground or <br />attached to the ground, including, but not limited to, buildings, factories, sheds, <br />cabins, mobile homes, and other similar items. <br /> <br />902.16 - General Provisions. <br /> <br />1. Lands to Which Orainance Applies. Th1.s ordinance shall apply to all lands <br />within the jurisdiction Of the City shown on the Official Flood Protection Maps <br />as being located within the boundaries of the Floodway and Flood Fringe Districts <br />and by the Flood Insurance Study for the City of Elk River as an tlnnumbered A Zone. <br /> <br />2. Official Flood Protection Maps. The following maps and studies are hereby <br />adopted by reference as the official maps for the establishment of floodplain areas <br />within the City and are hereby made a part of this ordinance as if fully set out <br />herein. At least one copy of each official map shall be kept on file in the office <br />of the Clerk-Administrator and shall be available for public review during all <br />normal office hours. <br /> <br />a. The Flood Boundary and Floodway, City of Elk River, Minnesota. and Flood <br />Insurance Rate Maps, City of Elk River, Minnesota, dated May 2, 1977, prepared <br />by the Federal Insurance Administration. <br /> <br />. <br /> <br />b. Specifically included in the above is the explanatory material, water <br />surface profiles and tabular information contained in the Federal Insurance <br />Administration Flood Insurance Study for City of Elk River, !{innesota, dated <br />May 2, 1977. <br /> <br />3. Rules for Interpretation of District Boundat'ie~. The flood hazard boundaries <br />shall be determined by scaling distances on the Federal Insurance Administration <br />Flood Boundary and Floodway Maps and with reference to the mate~ials contained <br />in the Federal Insurance Administration Flood Insurance Study .for the City of Elk <br />River. Where interpretation is needed as to the exact location of the boundaries <br />of a Floodway or Flood Fringe District, for example, where there appears to be <br />a conflict between a mapped boundary and actual field conditions, the City Council <br />shall make the necessary interpretation based on elevations on the applicable water <br />surface profile. Any person who wishes to contest the location of a Floodway or <br />Flood Fringe District boundary shall be gi.ven a reasonable opportunity to present <br />his case to the City Council serving as the Board of Adjustment and to submit <br />technical evidence if he so desires. <br /> <br />4. Compliance. No structure or land shall hereafter be used and no structure <br />shall be located, extended, converted, or structurally altered without full <br />compliance with the terms of this ordinance and other applicable regulations which <br />apply to uses within the jurisdiction of this ordinance. <br /> <br />902.18 - Establishment of Zoning Dist~~. <br /> <br />. <br /> <br />1. The Zoning Districts as designated on the Zoning Map of the City of Elk River <br />shall remain unchanged with the adoption of this ordinance. TI\e provisions of <br />this ordinance, including the designation of floodplain areas, shall be in addition <br />to all other provisions of the Zoning Ordinance of the City of Elk River.
