Subdivider's ownership and control; or <br /> <br />3. Landowners (Homeowners) Association ownership and control, provided all of <br />the following conditions are met: <br /> <br />a. The Landowners (Homeowners) Association must be established prior to the <br />sale of any lot; <br /> <br />b. Membership must be mandatory for each owner and any successor in interest; <br /> <br />c. The open space restrictions must be in perpetuity and not for a specified <br />term of years; <br /> <br />d. The Association must be responsible for liability insurance, local taxes, <br />and the maintenance of residential and other facilities; <br /> <br />e. Landowners (Homeowners) must pay their pro rata share of associated costs <br />and the assessment levied by the Association shall become a lien on the <br />property in accordance with the Law; and <br /> <br />f. The Association must be able to adjust the assessment to meet changed <br />circumstances and needs. <br /> <br />1008.22 - Improvements Required. <br /> <br />. <br /> <br />1. Improvements Listed and Described. Prior to the approval of a final plat by <br />the City Council as the Platting Authority under the Law, the subdivider shall <br />have agreed in the manner set forth in this Section 1008.22 to cause the following <br />improvements and those improvements required by the resolution granting approval <br />of the preliminary plat to be completed or completion secured on the site: <br /> <br />. <br /> <br />a. Survey Monuments - All subdivision boundary corners, block and lot corners, <br />road intersection corners and points of tangency and curvature shall be marked <br />with durable iron or steel survey monuments meeting the minimum requirements <br />of state law. Permanent monuments shall be placed at all quarter-quarter <br />section points within the subdivision plat or on its perimeter. At all <br />sections, quarter sections, meander or witness corners of the government survey <br />within the subdivision, on its perimeter or otherwise shown on the face of <br />the plat, a Sherburne County cast iron monument shall be placed and a <br />"Certificate of Location of a Government Corner" shall be filed with the office <br />of the County Recorder. The notation "Sherburne County Monument" shall be <br />placed on the face of the plat by each monument so shown. In addition, a <br />"Sherburne County Monument" shall be placed and a "Certificate" filed for <br />each government survey corner necessary to survey the boundaries of the plat <br />if such monument has not already been set and a certificate filed. All U.S., <br />state, county, and other official benchmark monuments or triangulation station <br />in or adjacent to the property shall be preserved in position unless a <br />relocation is approved by the controlling agency. The City Council may, when <br />a subdivision is essentially complete, require a development to have the plat <br />restaked to replace the original monuments destroyed or obliterated during <br />the construction process. <br /> <br />20. <br />
