<br />. <br /> <br />factors make the imposition of additional <br />standards or requirements necessary to <br />protect and safeguard the public health, <br />safety, and general welfare. <br /> <br />604.26 - sanitary Landfills. <br /> <br />1. Prohibited Areas. No Sanitary Landfill shall be <br />located, operated, or maintained in any area of <br />the city other than in those areas where <br />Sanitary Landfills are a permitted or a <br />conditional use pursuant to the provisions of <br />Article IX of the city Code. Waste disposal <br />areas within a sanitary landfill are prohibited <br />within the following areas: <br /> <br />(a) 1,000 feet from the normal high water mark <br />of a lake, pond, or flowage; <br /> <br />(b) 300 feet from a stream; <br /> <br />(c) A regional flood plain (100 year flood); <br />(d) A Wetland; <br /> <br />. <br /> <br />(e) 1,000 feet of the nearest edge of the right <br />of way of any state, federal, or interstate <br />highway or boundary of a public park or of <br />an occupied dwelling. permission may be <br />granted to vary the distance requirements <br />of subsection (e) in the discretion of the <br />city Council, taking into consideration <br />such factors as dust, noise, litter, and <br />other aesthetic and environmental <br />considerations. <br /> <br />(f) Locations considered hazardous because of <br />proximity to airports. <br /> <br />(g) An area which is unsuitable because of <br />reasons relation to topography, geology, <br />hydrology, soils, air quality, or proximity <br />to wells used for potable water supply. <br /> <br /> <br />2 . <br /> <br />License Required. It is unlawful for any person <br />to establish, operate, or maintain a Sanitary <br />Landfill without first being licensed to do so <br />by the City. Application for a solid Waste <br />Facility license to permit the operation of a <br />Sanitary Landfill shall be made in writing to <br />the city and delivered to the city Building and <br />zoning Administrator.
