<br />SECTION 2. AUTHORITY GRANTED <br /> <br />The City grants to Rite Cable permission to use the <br />streets for erecting, constructing, operating and main- <br />taining the cable communications system. <br /> <br />SECTION 3. AGREEMENT <br /> <br />Rite Cable agrees to be bound by all terms of the <br />franchise and to provide all services set forth in its <br />proposal to City. <br /> <br />SECTION 4. FRANCHISE TERM <br /> <br />The franchise shall be for a IS-year term from the date <br />of acceptance. <br /> <br />SECTION S. AREA <br /> <br />The franchise is granted for the City as it exists from <br />time to time during the term of the Franchiae. <br /> <br />SECTION 6. POLICE AND EMINENT DOMAIN POWERS <br /> <br />Rite Cable's rights are subject to the rights of eminent <br />domain of the City and to the policy powers of the City. <br /> <br />SECTION 7. USE OF GRANTEE FACILITIES <br /> <br />The City has the right to install and maintain any <br />fixtures it desires upon the poles and within the under- <br />ground pipes and conduits and fixtures of Rite Cable. <br /> <br />SECTION 8. WRITTEN NOTICE <br /> <br />All notices shall be delivered in writing to the offices <br />of City and the St. Paul office of Rite Cable. <br /> <br />SECTION 9. RIGHTS OF INDIVIDUALS <br /> <br />No signals shall be transmitted from the subscriber <br />terminal except as required to provide service authorized by <br />the franchise and the subscriber. Information from sub- <br />scriber terminals may not be gathered or stored without the <br />express written permission of the subscriber. The terms and <br />conditions of the written authorization are included in this <br />section. <br /> <br />SECTION 10. CERTIFICATE OF CONFIRMATION <br /> <br />Rite Cable must obtain a regular certificate of con- <br />firmation from the Minnesota State Cable Board. <br /> <br />- 2 - <br />
