<br />. <br /> <br />. <br /> <br />. <br /> <br />reference, shall, upon conviction be subject to a fine or not <br />more than $700 or imprisonment for a term not to exceed 90 days <br />or both, plus, in either case, the costs of prosecution. <br /> <br />2. Separate Violations: Unless otherwise provided, each act <br />of violation and every day which a violation occurs or <br />continues constitutes a separate offense. <br /> <br />3. Application to City Personnel: The failure of any officer <br />or employee of the City to perform any official duty imposed by <br />this ordinance shall not subject the officer or employee to the <br />penalty imposed for violation unless a penalty is specifically <br />provided for such failure. <br /> <br />4. In addition to other penalties imposed for violation of <br />this Ordinance, any person violating any of the provisions of <br />this Ordinance shall become liable to the City for any expense, <br />loss or damage occasioned by the City by reason of such <br />violations. <br /> <br />SECTION 1302 - SANITARY SEWER USER RATES AND CHARGES <br /> <br />SECTION 1302.00 - DEFINITIONS <br /> <br />Unless the context clearly indicates otherwise, the words, <br />combination of words, terms and phrases used in this Section <br />shall have the meanings hereinafter designated. <br /> <br />Further, terms defined in Section 1300 are hereby incorporated <br />by reference. <br /> <br />CAPITAL COSTS: All reasonable and necessary costs and <br />expenses incurred by the City in planning, designing, <br />financing, and constructing disposal system facilities, <br />including, but not limited to, costs and expenses for obtaining <br />necessary permits, licenses, approvals and grants for design <br />and construction costs, fees for legal and consulting services, <br />or the acquisition of such facilities. <br /> <br />COMMERCIAL USER: All users of the system classified as <br />industrial users in the "Standard Industrial Classification <br />Manual, 1972," United State Office of Management and Budget, as <br />amended and supplemented under Divisions A, B, C, E and I, but <br />who are excluded from that definition for the purposes of this <br />ordinance because they discharge primarily segregated domestic <br />wastes, or wastes from sanitary conveniences. The <br />classification shall not include such exempted users who are <br />otherwise classified in this ordinance as domestic users, <br />governmental users, or institutional users. <br /> <br />CONTRACT USER: All users who have written contracts with the <br />City to use the City sewer system or City wastewater treatment <br />plant. <br />
